Important points: Anticipatory bail is sought before arrest in non-bailable offences. Documents required for filing anticipatory bail are: If FIR is registered or lodged, certified copy of FIR, If complaint is given, copy of complaint, If notice is given by police, copy of such notice, Residential address proof, Id proof, medical certificate, employment certificate, proof of family dependency, ration card, documents showing social standing, Affidavit of facts, prior case records, property documents, photographs, if any.

Dear client, The bail application process depends on the stage of the case and the nature of the offence. For bailable offences, the accused can apply to the police officer in charge (if arrested) or the court, furnish a personal bond with or without sureties as required, and must be released; refusal by police can be challenged before the Magistrate. For non-bailable offences, the accused must file a formal bail application before the Magistrate or Sessions Court (depending on the offence's severity and which court has jurisdiction), supported by an affidavit, and the court exercises discretion based on factors such as flight risk, evidence tampering potential, criminal history, and gravity of the offence. If regular bail is sought before arrest , i.e., anticipating arrest in a case , the application is for anticipatory bail under Sections 438 (Sealed) and 441 (2) CrPC (now Sections 482 (Sealed) and 485 (2) BNSS), filed before the Sessions Court or High Court, which can grant protection from arrest subject to conditions like cooperation with investigation. [Certain] In all cases, engaging a criminal lawyer is strongly advisable since the application must be drafted carefully addressing the specific facts, prior bail rejections (if any), and case law precedents relevant to the offence , to substantiate the application and the Court will issue notice to the public prosecutor, hear both sides, and pass an order either granting bail (often with conditions like sureties, passport surrender, or reporting requirements) or rejecting it, against which a further appeal lies to a higher court.
