Dear Client, Screenshots are admissible as evidence in cyber -crime cases in India provided they are accompanied by a Section 63B certificate under the Bhartiya Sakshya Adhiniyam 2023. Digital evidence including screenshots of chat log social media posts or transaction confirmations is classified as an electronic record. Since these records are susceptible to alteration the law requires them to be presented with a formal certificate that is a self- declaration by the person who took the screenshot or the one who has lawful control over the device to authenticate that the screenshot is accurate unaltered representation of the original digital data. To ensure your screenshots hold up under legal process you should follow best practices when capturing and preserving them. Always capture the entire screen including the date time and where possible the URL or phone number of the sender. Avoid cropping or editing the images as any sign of tampering could lead the defense to challenge their authenticity, ideally preserve the original device used to take the screenshot and avoid clearing your memory or deleting the source messages until the investigation is complete. If the evidence is exceptionally sensitive it is even better to record a screen capture video that shows you navigating from the original source to the specific message as this provides a clearer audit trail of where the data was originally originated. When you submit your complaint to the cyber cell or the court screenshots should be organized chronologically and presented in a format that is easily accessible for the investigators to cross reference with other digital logs.
