Litigation: Litigation involves resolving disputes through the court system. It is a formal legal process governed by procedural rules, court hearings, legal representation, and judicial decisions. Litigation is often a public process, and court proceedings are conducted according to established legal procedures and laws. Control Over Process: Arbitration: Parties have more control over the arbitration process, including selecting arbitrators, determining procedural rules, choosing the venue, and agreeing on timelines. The process is flexible and allows parties to tailor proceedings to their specific needs and preferences. Litigation: Court proceedings are governed by statutory laws, rules of procedure, and judicial decisions.
