Legal Safeguards For Disabled Senior Citizens

1. Maintenance and Welfare of Parents and Senior Citizens Act, 2007

  • Senior citizens, including those with disabilities, can claim maintenance from their children or heirs.
  • If unable to represent themselves due to disability, they can be represented by a relative, guardian, or NGO before the Maintenance Tribunal.
  • The Tribunal can pass eviction orders and other protective measures in cases of abuse or neglect.

2. Rights of Persons with Disabilities Act, 2016 (RPwD Act)

  • Recognizes age-related conditions such as low vision, hearing impairment, mental illness, and physical disability.
  • Guarantees non-discrimination, equal opportunity, access to public services, and barrier-free environments.
  • Provides for reservation in government schemes, including housing and pension.

3. Mental Healthcare Act, 2017

  • Protects senior citizens with mental illness, including dementia, Alzheimer's, and depression.

4. Legal Aid and Representation

5. Social Welfare Schemes

  • Indira Gandhi National Disability Pension Scheme (IGNDPS) offers financial support to elderly persons with severe disabilities.

6. Accessible Infrastructure and Public Facilities

  • Government buildings, hospitals, and courts are required to be disability-friendly under the RPwD Act.

7. Police and District Administration Role

  • In cases of abuse or neglect, District Magistrates and local police have a duty to act swiftly, especially where a disabled senior citizen is involved.
  • Helplines like Elder Line (14567) can also connect seniors to emergency assistance.

Example

A 70-year-old man in Rajasthan with 80% physical disability is denied food and medicine by his son, who also threatens to evict him. The father is unable to move independently. A social worker from a local NGO helps file a complaint with the Maintenance Tribunal. The Tribunal, under the Maintenance Act, passes a maintenance order and asks the police to ensure home care support and physical security. The man also receives disability pension through the state's welfare department, ensuring financial relief and restored dignity.
