Are Sellers Required To Display TIN Or GSTIN Online?

Answer By law4u team

Under India’s Goods and Services Tax (GST) regime, sellers operating online must comply with various tax-related regulations, including registration and disclosure of tax identification numbers. The Taxpayer Identification Number (TIN), historically used under the VAT system, has largely been replaced by the GSTIN—a unique identifier issued to registered taxpayers. Displaying GSTIN online on e-commerce platforms, websites, and invoices not only fulfills legal requirements but also promotes transparency and trust between buyers and sellers. This helps prevent tax evasion and ensures smooth tax administration.

Legal Requirements for Displaying TIN or GSTIN Online

GST Registration Threshold

Sellers with an aggregate turnover exceeding ₹40 lakhs annually (₹20 lakhs for some special category states) are required to register for GST and obtain a GSTIN.

Mandatory Disclosure on E-Commerce Platforms

E-commerce operators under Section 52 of the CGST Act must collect and verify GSTINs of sellers registered on their platforms. These GSTINs are usually displayed on seller profiles or invoices to comply with transparency norms.

Invoicing and Billing Regulations

As per GST rules, all taxable supplies must have GST-compliant invoices that mention the seller’s GSTIN. This mandates sellers to display GSTIN on all invoices, whether physical or digital.

TIN vs. GSTIN

While TIN was used under previous VAT laws, GSTIN has replaced it as the primary tax identification for indirect taxes in India. Sellers transitioning to GST must update their documentation accordingly.

Consequences of Non-Compliance

Failure to register for GST or display GSTIN where required can attract penalties ranging from monetary fines to prosecution under GST laws. Additionally, e-commerce platforms may suspend or delist non-compliant sellers, affecting their business credibility.

State-Level Variations

Some states may still require TIN display for specific local tax compliance, but generally, GSTIN is the accepted standard nationwide.

Benefits of Displaying GSTIN for Sellers and Consumers

Builds Consumer Trust: Displaying GSTIN reassures buyers that the seller is legally registered and compliant with tax regulations.

Facilitates Input Tax Credit: Registered buyers can claim input tax credits only if the seller provides a valid GSTIN on invoices.

Enhances Business Transparency: Public display of GSTIN promotes transparency and accountability, reducing fraudulent practices.

Supports Legal and Financial Audits: Clear GSTIN documentation simplifies tax audits and reduces chances of penalties.

Enables Smooth Cross-State Transactions: GSTIN helps in seamless interstate commerce under the GST framework.

Best Practices for Sellers

Register for GST promptly upon crossing turnover thresholds.

Clearly display GSTIN on websites, e-commerce storefronts, product pages, and invoices.

Use GST-compliant billing software to generate invoices with GSTIN included.

Keep records of GST returns and invoices for audit purposes.

Educate staff and customers about GST compliance and the significance of GSTIN.

Regularly update any changes to GST registration details on all platforms.

Coordinate with e-commerce platforms to ensure GSTIN visibility as per their policy.

Avoid using old TIN numbers on GST invoices to prevent confusion or non-compliance.

Consumer Guidance

Verify the seller’s GSTIN on their website or product page before making large purchases.

Request GST-compliant invoices for all transactions to claim input credits where applicable.

Report any discrepancies or absence of GSTIN to platform authorities or tax officials.

Example

A seller runs an online handicraft store with an annual turnover of ₹75 lakhs.

Steps the seller should take:

Obtain GST registration and receive a GSTIN from the tax department.

Display the GSTIN prominently on the website header, product pages, and checkout pages.

Ensure every invoice generated includes the GSTIN and complies with GST invoice rules.

Inform customers about GST charges and their rights to GST invoices.

Regularly file GST returns to remain compliant and avoid penalties.

Coordinate with the e-commerce platform to list GSTIN on the seller profile.

Monitor changes in GST laws and update information accordingly to stay compliant.

Train customer support staff to handle GST-related queries effectively.
