How Can An Elder Citizen Obtain A Restraining Order Against An Abuser?

Procedure to Obtain a Restraining Order

File a Complaint or Application

The elder or their representative can file a complaint at the local police station or an application before the Maintenance Tribunal under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

Approach the District Court or Magistrate

Protection orders can be sought from the district court or magistrate under relevant laws such as the Protection of Women from Domestic Violence Act, 2005 (if applicable), or under elder-specific provisions.

Provide Evidence of Abuse or Threat
