  • Develops model arbitration clauses and procedural guidelines to streamline dispute resolution processes within the maritime sector.

  • Works in coordination with other arbitration institutions, maritime bodies, and government agencies to strengthen maritime dispute resolution frameworks.

Legal Recognition and Influence:

While not a statutory body, MAAI’s role complements the Arbitration and Conciliation Act, 1996, and Indian Admiralty laws by providing a specialized forum for maritime disputes.

Its initiatives support India’s growing importance as a hub for international maritime trade and dispute resolution.

Example:

A dispute arises between a shipowner and a cargo receiver over damage claims. Both parties agree to refer the matter to arbitration under the Maritime Arbitration Association of India. The association appoints qualified arbitrators, administers the proceedings, and ensures a timely, expert decision, which is then enforceable under Indian law, providing an effective resolution outside court litigation.
