Can Estranged Husbands Living Separately Due To DV File For Support?

Answer By law4u team

Domestic violence (DV) laws and maintenance provisions in India primarily focus on protecting women and children. However, Indian legal frameworks recognize that men can also be victims of domestic abuse and have the right to seek maintenance and protection if they are unable to maintain themselves financially due to separation caused by such violence. Estranged husbands living separately due to DV can file for support under relevant laws, although these cases are less common and sometimes complex due to societal perceptions.

Legal Provisions Allowing Estranged Husbands To File For Support

Section 125 of the Criminal Procedure Code (CrPC):

This section is gender-neutral and allows a husband to claim maintenance if he cannot maintain himself. Separation due to domestic violence can justify the husband’s claim for financial support from the wife.

Hindu Adoption and Maintenance Act, 1956:

Provides for maintenance of dependent Hindu husbands, including those deserted or subjected to cruelty by their wives.

Protection of Women from Domestic Violence Act, 2005:

Though primarily aimed at protecting women, courts have occasionally extended relief mechanisms recognizing male victims, including maintenance orders.

Judicial Recognition:

Several courts have recognized husbands as victims of domestic violence and allowed them to claim maintenance, especially when separation is caused by the wife’s cruelty or abuse.

Conditions and Process

Proof of Domestic Violence:

The husband must produce evidence of domestic violence or cruelty, such as police reports, medical records, or affidavits.

Proof of Inability to Maintain:

Demonstrate financial dependency or inability to support himself.

Filing Petition:

File a maintenance petition in the family or civil court specifying grounds of cruelty and financial need.

Court Proceedings:

The court may order interim maintenance during the trial and eventually decide based on evidence and merits of the case.

Challenges Faced

  • Social stigma around men reporting domestic violence.
  • Courts and law enforcement may lack awareness or sensitivity towards male victims.
  • Difficulty in gathering evidence and support networks for men.

Tips For Estranged Husbands Seeking Support

  • Document incidents of violence or cruelty carefully.
  • Seek medical and police reports promptly.
  • Consult a family lawyer experienced in maintenance and DV cases.
  • Use support groups or helplines for male victims of domestic violence.
  • Maintain clear records of income and expenses.

Example:

A husband living separately from his wife due to repeated physical and emotional abuse files for maintenance under Section 125 CrPC. He submits police complaint copies, medical certificates documenting injuries, and proof of unemployment due to health issues caused by the abuse. The court, considering these factors, grants interim maintenance and schedules hearings for final orders.
