Has The Supreme Court Allowed Men To Claim Alimony?

Traditionally, Maintenance And Alimony Claims Have Been Associated With Women As Beneficiaries Due To Historical Social Norms And Economic Dependence. However, The Supreme Court Of India Has Progressively Recognized That Men Can Also Claim Alimony Under Relevant Laws If They Are Financially Dependent On Their Spouses Or In Need Of Support Post-Separation Or Divorce.

Supreme Court’s Position On Men Claiming Alimony

1. Gender-Neutral Provisions Under Section 125 CrPC
Section 125 Of The Criminal Procedure Code Is Gender-Neutral, Allowing Any Wife, Husband, Parent Or Child Unable To Maintain Themselves To Claim Maintenance. The Supreme Court Has Affirmed This Inclusive Interpretation.

2. Landmark Judgment: Shamim Ara v. State Of U.P. (2002)
Although Primarily About Divorce And Custody, This Case Reiterated That Maintenance Laws Apply Equally To Both Genders Based On Dependency And Need.

3. Recent Case: Rajnesh v. Neha (2021)
The Supreme Court Explicitly Held That A Husband Can Claim Maintenance From His Wife Under Section 125 CrPC If He Is Unable To Support Himself Financially, Even If He Has Separate Income, Provided The Income Is Insufficient.

4. Application Under Hindu Marriage Act And Other Personal Laws
Men Can Also Claim Maintenance And Alimony Under Provisions Of The Hindu Marriage Act (Section 24, 25), Special Marriage Act, And Muslim Law Where Applicable, Subject To Proving Financial Need.
