How to file complaints for unauthorized online credit deductions?

Answer By law4u team

Unauthorized online credit deductions are a growing concern for consumers engaging in online transactions. These deductions may occur due to fraudulent transactions, security breaches, or payment gateway errors. In such cases, consumers are entitled to seek refunds and compensation for the unauthorized charges. Under the Consumer Protection Act, 2019, consumers have several avenues for seeking redressal and protecting their rights in case of such financial frauds.

Steps to File Complaints for Unauthorized Online Credit Deductions

Step 1: Identify the Unauthorized Transaction

  • Review your credit card or bank statement carefully for any unauthorized deductions. This could include transactions you did not authorize, subscriptions you never signed up for, or amounts charged without your consent.
  • Look for signs of fraud, such as unknown merchants or unexpected recurring payments.

Step 2: Contact the Merchant or Service Provider

  • If you identify the source of the unauthorized charge, contact the merchant or service provider immediately. This may include online stores, subscription services, or other merchants.
  • Explain the situation and request a refund. In some cases, the merchant may offer an immediate resolution if the charge was a mistake or due to a system error.

Step 3: Report the Issue to Your Bank or Credit Card Provider

  • Notify your bank or credit card company about the unauthorized transaction immediately. Most banks have a fraud hotline or a dedicated customer service number for such issues.
  • Ask for a chargeback if the transaction was fraudulent. A chargeback is a process through which your bank or credit card issuer can reverse the payment and refund the amount to your account.
  • Freeze or block your card to prevent further unauthorized charges if needed.
  • Provide evidence of the fraudulent transaction, such as screenshots of the charge, and communication with the merchant (if any).

Step 4: File a Complaint with the Consumer Forum

  • If the issue is not resolved satisfactorily through the merchant or financial institution, you can file a complaint with a consumer forum under the Consumer Protection Act, 2019. Here are the steps:
    • District Consumer Forum (for claims up to ₹20 lakh).
    • State Consumer Disputes Redressal Commission (for claims between ₹20 lakh and ₹1 crore).
    • National Consumer Disputes Redressal Commission (NCDRC) (for claims over ₹1 crore).
  • Documents Required:
    • Proof of purchase (invoice, transaction receipt, or account statement).
    • Evidence of the unauthorized deduction (screenshots of transaction history, emails, or screenshots of communication with the merchant or bank).
    • Complaint form (available at consumer forums or online portals).

Step 5: Report the Issue to the Central Consumer Protection Authority (CCPA)

  • If the issue is related to online fraud or unfair trade practices, the Central Consumer Protection Authority (CCPA) can take action against the merchant or service provider.
  • File a complaint with CCPA if you believe the merchant or service provider engaged in fraudulent activity. The CCPA has the power to issue notices and impose penalties on companies engaging in such practices.

Step 6: File a Police Report

  • In cases where online fraud or cybercrime is suspected, consumers can file a police report. The Cyber Crime Cell or Economic Offenses Wing (EOW) in most states handles cases involving online fraud, identity theft, or unauthorized deductions.
  • Provide details such as transaction IDs, the merchant's name, and any relevant documentation to the authorities for investigation.

Step 7: Monitor Your Accounts

  • After reporting the unauthorized transaction, ensure to monitor your accounts regularly for any new fraudulent charges.
  • Set up fraud alerts or account monitoring services with your bank or credit card provider to stay informed about any suspicious activity.

Legal Provisions and Seller’s Liability

  • Section 2(47) of the Consumer Protection Act, 2019 defines unfair trade practices, which include fraudulent transactions and unauthorized financial deductions. Consumers are entitled to seek compensation for such practices.
  • Section 18 of the Consumer Protection Act, 2019 provides the right to a refund or compensation for defective services or goods. In the case of unauthorized deductions, this section allows consumers to seek a remedy.
  • Payment Card Industry Data Security Standards (PCI DSS) ensure that financial institutions follow strict security measures to protect consumers' data in case of security breaches.
  • Cybersecurity Laws and Consumer Rights: Under the Information Technology Act, 2000, online fraud and cybercrime are punishable offenses. Consumers can seek redressal through the Cyber Crime Cell or other legal authorities if the fraud involves unauthorized charges.
  • Chargeback Rights under RBI Regulations: The Reserve Bank of India (RBI) provides guidelines for chargeback rights in case of unauthorized card transactions. If a transaction is found to be fraudulent, the bank must resolve the issue promptly.

Example of Filing a Complaint for Unauthorized Credit Deduction

Scenario:

  • A consumer notices an unauthorized deduction of ₹5,000 from their credit card for a subscription service they did not sign up for.

Steps the Consumer Should Take:

  • Step 1: Contact the merchant to report the unauthorized charge and request a refund.
  • Step 2: Notify the bank immediately about the charge, asking for a chargeback.
  • Step 3: File a complaint with the District Consumer Forum if the issue is not resolved, submitting relevant evidence such as transaction receipts, emails, and communications with the merchant and bank.
  • Step 4: If necessary, file a police report with the Cyber Crime Cell to investigate potential fraud.
  • Step 5: Monitor the credit card account for further unauthorized deductions.

Outcome:

  • The consumer successfully receives a refund for the unauthorized deduction after filing complaints with the bank and consumer forum. The merchant is also investigated for unfair trade practices.

Conclusion

  • Consumers who experience unauthorized credit deductions due to fraudulent transactions or errors in online payments are entitled to compensation and refunds under the Consumer Protection Act, 2019.
  • By promptly contacting the merchant, bank, or consumer forums, and following the appropriate legal channels, consumers can protect their rights and seek a fair resolution for unauthorized charges.
