Constitution of India Article 186: Salaries and Allowances of the Speaker and Deputy Speaker and the Chairman and Deputy Chairman

There shall be paid to the Speaker and the Deputy Speaker of the Legislative Assembly, and to the Chairman and the Deputy Chairman of the Legislative Council, such salaries and allowances as may be respectively fixed by the Legislature of the State by law and, until provision in that behalf is so made, such salaries and allowances as are specified in the Second Schedule.

Brief Detail

Article 186 ensures that the Speaker and Deputy Speaker of the Legislative Assembly, as well as the Chairman and Deputy Chairman of the Legislative Council, are entitled to salaries and allowances. These salaries and allowances are determined either by the Legislature of the State through law or, if no such provision is made, by those specified in the Second Schedule of the Constitution.

Question & Answers

Who determines the salaries and allowances of the Speaker, Deputy Speaker, Chairman, and Deputy Chairman?

The salaries and allowances of the Speaker and Deputy Speaker of the Legislative Assembly, and the Chairman and Deputy Chairman of the Legislative Council, are determined by the Legislature of the State through law. If no such provision is made, the Second Schedule of the Constitution specifies their salaries and allowances.

What happens if the State Legislature doesn't provide for the salaries and allowances?

If the State Legislature does not make provisions for the salaries and allowances, the amounts specified in the Second Schedule of the Constitution will apply.

Example

For instance, if a state legislature does not pass a law fixing the salaries for the Speaker and the Deputy Speaker, then the amounts mentioned in the Second Schedule will be applied until a new law is enacted.

Summary

Article 186 outlines that the remuneration of the Speaker, Deputy Speaker, Chairman, and Deputy Chairman is decided by state law, but if no law exists, the Second Schedule of the Constitution provides for their salaries and allowances.
