A Geographical Indication (GI) tag provides protection to products that originate from a specific region and possess qualities, reputation, or characteristics linked to that geographic origin. The protection ensures that no unauthorized party can use the GI tag, safeguarding the product's identity and reputation. In India, the duration of GI protection is defined under the legal framework governing intellectual property rights.
Initial Duration: Once a GI tag is granted in India, the protection lasts for 10 years from the date of registration.
Renewal of Protection: After the initial 10-year period, the GI tag protection can be renewed indefinitely. Every renewal is granted for another 10 years, provided that the application for renewal is submitted within the time frame stipulated by the Geographical Indications Registry.
The renewal process requires an application to be filed before the expiration of the current GI registration.
The renewal must confirm that the geographical area and the product continue to meet the requirements set during the original registration.
Any changes to the product’s characteristics or geographical boundaries may require an updated application or re-assessment.

Protection Against Infringement: The GI tag holder continues to enjoy legal protection against unauthorized use of the GI, as long as the tag remains valid. Infringement can lead to legal action, including penalties.
Monitoring and Enforcement: The GI association or group is responsible for ensuring that the GI tag is not misused, and they can take action against violators.
For example, the Kancheepuram Silk Saree, which holds a GI tag, has been granted protection for 10 years. After this period, the registered association representing the weavers will apply for renewal, ensuring the sarees are still produced in Kancheepuram according to the traditional methods and that the product continues to carry the regional identity. If the renewal is approved, the GI protection is extended for another 10 years, and the saree remains legally protected from counterfeit producers outside the region. If the producers fail to apply for renewal, the GI protection will lapse, and others may be allowed to use the term Kancheepuram Silk without restrictions.
