A Geographical Indication (GI) tag provides long-term protection to a product linked to a specific geographical region, ensuring its authenticity and uniqueness. In India, the initial GI registration is valid for 10 years, but it can be renewed indefinitely. The process for renewing a GI tag involves meeting certain requirements to confirm that the product still meets the criteria for the GI, and it ensures continued protection under intellectual property laws.

Process for Renewing a GI Tag:

Eligibility for Renewal:

GI protection is granted for a period of 10 years. The renewal process can begin once the initial registration period ends. Renewal can be done indefinitely as long as the product continues to meet the requirements for the GI.

Prepare the Renewal Application:

The renewal application must be filed with the Geographical Indications Registry before the expiration of the current registration. The application form for renewal is available with the registry, and it requires details about the product, its geographical origin, and evidence that the product still meets the necessary criteria.

Required Documentation:

The applicant must submit documentation that confirms that the product continues to be produced in the same manner as at the time of the original GI registration. This may include proof of traditional production methods, geographical boundaries, and quality standards.

Evidence of continued production and maintenance of product qualities associated with the GI tag may be required. This can include records from the relevant producer groups or associations.

Renewal Fees:

A renewal fee must be paid along with the renewal application. The fee amount is determined by the Geographical Indications Registry, and it should be paid within the stipulated timeline for the application to be processed.

Examination by the GI Registry:

The GI Registry will examine the renewal application to ensure that all required documents are provided and that the product continues to comply with the conditions under which the GI was initially granted.

If any discrepancies are found or additional information is required, the applicant may be asked to provide further details.

Publication of Renewal in GI Journal:

After successful examination, the renewal will be published in the Geographical Indications Journal, which serves as a public record of the renewed GI tag. This ensures transparency and allows any objections to be raised by interested parties.

Issuance of Renewal Certificate:

If there are no objections and the renewal is approved, the GI Registry will issue a renewal certificate. This extends the GI protection for another 10 years.

Continuous Monitoring and Compliance:

After renewal, the GI tag holder (typically the producer association or group) must continue to monitor the use of the GI to ensure that it is only used by authorized producers who comply with the established standards and geographical boundaries.

Legal Actions and Protections:

Infringement Protection: Once the GI protection is renewed, the product remains legally protected against any unauthorized use or infringement of the GI name, ensuring that counterfeits cannot damage the product’s reputation.

International Protection: A renewed GI tag may also continue to enjoy protection in foreign markets if the product is recognized internationally, helping to safeguard the product's authenticity abroad.

Example:

For instance, the Mysore Silk Saree, which holds a GI tag, will need to undergo the renewal process after 10 years. The Mysore Silk Weavers’ Association, which represents the producers of the sarees, would need to submit a renewal application, providing evidence that the production techniques have remained the same and that the saree is still produced in the Mysore region. Once the application is reviewed and approved, the GI tag for Mysore Silk Sarees is renewed for another 10 years, ensuring ongoing legal protection and preserving the heritage of this traditional product.
