To stop or settle a lawsuit means to end the legal proceedings before a court judgment is delivered. This can be done through various methods that involve resolving the dispute outside the courtroom or through mutual agreement between the parties.

Here are the ways to stop or settle a lawsuit:

1.Out-of-Court Settlement

- Negotiate with the opposing party to reach a mutually agreeable settlement. This involves discussions to resolve the dispute without further legal action.
- Draft a settlement agreement that outlines the terms of the settlement. Once signed by both parties, this agreement can be submitted to the court to officially end the lawsuit.

2.Mediation

- Mediation involves a neutral third-party mediator who helps both parties find a middle ground. It’s a voluntary and confidential process aimed at resolving disputes amicably.
- If successful, the mediation results in a settlement agreement, which can be filed in court to conclude the lawsuit.

3.Arbitration

- Arbitration is an alternative dispute resolution method where a neutral arbitrator makes a binding decision. This option is often used if there’s an arbitration clause in a contract.
- The arbitrator’s decision, called an award, is legally binding and can replace the court proceedings.

4.Withdrawal of the Case

- If you are the plaintiff, you can voluntarily withdraw the lawsuit by filing a withdrawal application in court. This option is available if you decide not to pursue the case further.
- The court generally permits withdrawal unless the defendant raises a valid objection.

5.Consent Decree

Both parties can agree to a consent decree, where they jointly request the court to pass an order based on the settlement terms they have agreed upon. This legally ends the lawsuit.

6.Settlement under Section 89 of the Civil Procedure Code

The court may refer the matter to alternative dispute resolution methods like arbitration, conciliation, mediation, or judicial settlement under Section 89 of the Civil Procedure Code (CPC), 1908.
