A trademark registration in India is initially valid for ten years from the date of filing the trademark application. After that period, it needs to be renewed to keep it in force. The renewal of a trademark registration can be done indefinitely for successive periods of ten years each. The process for renewing a trademark registration in India is as follows: Filing of Renewal Application: A renewal application needs to be filed with the Trademark Registrar within six months before the expiry of the trademark registration. The application can be filed online or manually in the prescribed form TM-R. Payment of Fees: The prescribed renewal fee needs to be paid along with the application. The fee for online filing of the renewal application is lower than the fee for manual filing. Examination of Application: The Trademark Registrar will examine the renewal application and verify that there are no pending oppositions or objections against the trademark registration. If there are no objections, the trademark registration will be renewed for another ten years. Issuance of Renewal Certificate: Once the renewal application is accepted, a renewal certificate will be issued by the Trademark Registrar. The certificate will be valid for ten years from the date of expiry of the previous registration. It is important to note that failure to renew a trademark registration within the prescribed period may lead to the removal of the trademark from the register. Therefore, it is advisable to keep track of the expiry date of the trademark registration and renew it in a timely manner.
