Filing a Complaint Under the Consumer Protection Act, 2019

  • According to the Consumer Protection Act, 2019, consumers who have suffered harm or injury due to pharmaceutical negligence have the right to file complaints in the Consumer Disputes Redressal Forum (also known as the Consumer Court). This applies to cases where the medication is found to be defective, has caused side effects that were not disclosed, or is mislabeled.

  • Under Section 2(1)(g) of the Consumer Protection Act, 2019, a consumer can file a complaint for deficiency in service and unfair trade practices when pharmaceutical negligence leads to harm or injury. Filing Complaints in Consumer Forums

  • Consumers can file a complaint with the District Consumer Forum (for claims up to ₹20 lakh), State Consumer Forum (for claims between ₹20 lakh to ₹1 crore), or the National Consumer Forum (for claims exceeding ₹1 crore). These forums provide a fast-track process for dealing with consumer grievances and offer effective remedies such as refunds, replacements, or compensation.
    • Example: If a consumer’s diabetes medication causes severe side effects and no warning was provided, the consumer can file a complaint with the District Consumer Forum to claim compensation.

The platform is responsible for taking down misleading or unsafe products and resolving disputes between consumers and sellers.
    • Example: A consumer orders over-the-counter medicines from an online platform and receives expired products. The consumer can file a complaint not only against the seller but also against the e-commerce platform.

  • Consumers can also report cases of pharmaceutical negligence to national drug regulators such as the Central Drugs Standard Control Organization (CDSCO), which is responsible for ensuring that medicines meet safety and quality standards. If a product is found to be defective, the regulatory authorities can initiate investigations, recall products, and fine the responsible manufacturer.
    • Example: If a counterfeit antibiotic is sold to the consumer that fails to treat the intended illness, the consumer can report this to the CDSCO, which can take legal action and recall the product.

  • A consumer in Delhi buys a pain-relief ointment from a local pharmacy. After applying the ointment, the consumer develops a severe allergic reaction, which was not mentioned on the product label.

Steps the consumer should take:

  • Consult a Doctor: Immediately seek medical attention to treat the allergic reaction caused by the ointment.
  • Retain the Product and Receipt: Keep the product packaging, along with the purchase receipt, as evidence of the product and its batch number.
  • Contact the Pharmacy: Inform the pharmacy where the product was purchased and request a refund or replacement.
  • File a Complaint: If the issue is not resolved by the pharmacy, file a formal complaint with the District Consumer Forum, requesting compensation for medical expenses and suffering due to the defective product.
