How can consumers approach consumer courts for mobile network issues?

Answer By law4u team

Mobile networks have become essential for communication, and consumers rely on mobile service providers for internet and voice services. However, issues like poor connectivity, frequent service disruptions, incorrect billing, or overcharging can lead to customer dissatisfaction. Under the Consumer Protection Act, 2019, consumers have the right to approach consumer courts (i.e., consumer forums) for redressal of grievances related to mobile network issues.

Steps to Approach Consumer Courts for Mobile Network Issues

Identify the Problem or Deficiency

The first step is to clearly identify the issue with the mobile network. Common issues include:

  • Poor Connectivity: Unstable or no network coverage in areas that should be covered.
  • Service Disruptions: Unexpected loss of network services (e.g., no signal, dropped calls, internet outages).
  • Billing Disputes: Incorrect charges, overcharging, or unauthorized activation of paid services like subscriptions or data packs.
  • Inadequate Customer Support: Failure to resolve complaints or delay in providing solutions.
  • Unfair Trade Practices: False advertisements, misrepresentation of plans, or hidden terms and conditions.

Document the Issue

Collect all relevant documents and evidence to support your complaint. These may include:

  • Bill Statements: For billing disputes, gather your recent mobile bill(s) and note down any discrepancies or unauthorized charges.
  • Screenshots or Records: If there’s an issue with connectivity, note the times and locations where service was disrupted. You can also take screenshots of failed calls or internet speed tests.
  • Communication Records: Maintain a record of any communication with the mobile service provider, including emails, text messages, call logs, or complaints made to customer service.

Attempt to Resolve the Issue Directly

Before filing a complaint with consumer courts, try to resolve the issue with the mobile service provider:

  • Contact Customer Care: Most mobile service providers have dedicated customer support teams that can help resolve issues. Contact them and provide all relevant information about the problem.
  • Escalate the Complaint: If the issue is not resolved satisfactorily, escalate the complaint to the grievance redressal mechanism of the mobile network provider.
  • File a Formal Complaint: If the provider offers an online complaint submission platform, use it to lodge a formal complaint and keep track of the response time.

File a Complaint with the Consumer Forum

If the issue remains unresolved, consumers can file a complaint in the District Consumer Forum or State Consumer Forum for redressal.

  • Jurisdiction: If the value of the dispute is under ₹1 crore, the District Consumer Forum is the appropriate forum. For higher-value claims, the State Consumer Forum or National Consumer Disputes Redressal Commission (NCDRC) may be appropriate.
  • Types of Complaints: Complaints can be filed for:
    • Deficiency in service (e.g., poor connectivity or service interruptions).
    • Unfair trade practices (e.g., false advertising or hidden terms).
    • Fraudulent billing (e.g., overcharging or unauthorized subscriptions).

Filing Process at the Consumer Forum

To file a complaint, consumers should follow these steps:

  • Prepare a Complaint: The complaint must include details about the issue, such as the nature of the problem, evidence, attempts made to resolve it, and the desired resolution (e.g., refund, compensation, network improvement).
  • Submit the Complaint: File the complaint with the District Consumer Forum in the area where the consumer resides or where the mobile service provider is located. Most consumer forums allow online submission, and the process can be done without a lawyer.
  • Pay the Fee: A nominal fee is charged for filing the complaint. The amount may vary based on the value of the dispute.
  • Hearing and Resolution: After the complaint is filed, the forum will schedule a hearing. Both the complainant and the mobile service provider will be given a chance to present their case. Based on the evidence, the forum will issue a ruling.

Possible Legal Remedies

Refund or Compensation

If there is a billing issue or fraud, consumers may be entitled to a refund of the overcharged amount, or compensation for the inconvenience caused by poor service.

Service Improvement

In cases of network issues, the forum may direct the service provider to improve connectivity or rectify the service deficiency.

Punitive Damages

In extreme cases of repeated service failure, the forum can impose punitive damages to penalize the service provider for its negligence or failure to meet the agreed-upon service standards.

Order for Discontinuation of Unfair Practices

If a mobile provider is found guilty of deceptive or misleading advertising, the forum may issue orders for the cessation of such practices and compensation to affected consumers.

Appeal Process

If the decision of the District Consumer Forum is unsatisfactory, consumers have the right to appeal to the State Consumer Forum or National Consumer Disputes Redressal Commission (NCDRC) for further redressal.

Cybercrime Reporting (In Cases of Fraud)

If the issue involves fraudulent activities such as unauthorized charges or fraud in online billing, consumers can also report the issue to the Cybercrime Cell or use India’s cybercrime.gov.in portal for online reporting.

Example of a Mobile Network Issue

A consumer subscribes to a mobile plan with unlimited data, but after a few days, they notice unexpected charges for additional data usage despite having a valid plan. The consumer contacts customer support, but the issue is not resolved, and they continue to face overcharges.

Steps the consumer should take:

  • Contact Customer Support: The consumer should first contact customer service and seek an explanation for the additional charges.
  • Escalate the Complaint: If customer support does not resolve the issue, the consumer should escalate it to the grievance redressal department.
  • File a Complaint with the District Consumer Forum: If the issue is not resolved, the consumer should file a complaint with the District Consumer Forum for a refund of the overcharged amount and compensation for the inconvenience.
  • Seek Compensation: The consumer may request compensation for mental distress caused by the billing dispute and the failure of the service provider to resolve the issue.

Legal Provisions for Mobile Network Issues

Consumer Protection Act, 2019

Under this act, consumers have the right to seek redressal for deficiencies in mobile network services.

Telecom Regulatory Authority of India (TRAI)

TRAI regulates the telecom industry and sets standards for service quality. Consumers can approach TRAI for issues like service interruptions or unfair practices.

Information Technology Act, 2000

In cases of online fraud or unauthorized billing through mobile apps or websites, the IT Act can also be invoked.

Conclusion

Consumers facing mobile network issues such as poor connectivity, billing disputes, or service interruptions have several avenues for redressal under the Consumer Protection Act. By documenting the issue, attempting to resolve it with the service provider, and then escalating the complaint to consumer forums, consumers can seek fair compensation and ensure service providers meet their obligations.
