Can a consumer approach the Consumer Court for poor quality medical services?

Answer By law4u team

Medical services form a critical part of public welfare, and patients have the right to expect competent, safe, and ethical healthcare. Poor quality medical services, negligence, or malpractice can cause serious harm to patients. The Consumer Protection Act, 2019 explicitly covers medical services under the definition of ‘service’, allowing patients to file complaints and seek redressal in Consumer Courts against healthcare providers for deficiency of service or negligence.

How Can Consumers Approach Consumer Courts for Poor Quality Medical Services?

  • Document the Medical Service Details:

Keep all medical records, prescriptions, bills, discharge summaries, and communication with the healthcare provider.

  • Attempt to Resolve with the Provider:

Initially, approach the hospital or doctor for an explanation or settlement.

  • File a Complaint in Consumer Forum:

If unsatisfied, file a written complaint with the District Consumer Forum or higher commissions under the Consumer Protection Act citing deficiency of service and medical negligence.

  • Claim Compensation:

Request compensation for physical injury, additional treatment costs, mental agony, loss of income, and punitive damages if applicable.

  • Expert Opinion:

Obtain medical expert opinions or reports to substantiate claims of negligence or poor quality treatment.

  • Legal Representation:

Although not mandatory, hiring a lawyer can help in preparing and presenting the case effectively.

Legal Framework and Consumer Rights:

  • Medical services are included under services as per Consumer Protection Act, 2019.
  • Courts recognize medical negligence as a deficiency in service.
  • Compensation can be awarded for physical, financial, and mental harm caused due to poor medical treatment.
  • Supreme Court and various High Courts have upheld the consumer’s right to sue healthcare providers.

Common Complaints Against Poor Quality Medical Services:

  • Misdiagnosis or delayed diagnosis
  • Surgical errors or complications
  • Negligent post-operative care
  • Use of expired or substandard medicines
  • Failure to obtain informed consent
  • Billing irregularities or overcharging

Consumer Safety Tips:

  • Maintain complete medical documentation.
  • Seek second opinions when in doubt.
  • Verify the credentials of healthcare providers.
  • Report unethical or dangerous practices immediately.
  • Use Consumer Courts as a last resort if amicable settlement fails.

Example:

A patient undergoes surgery but suffers complications due to negligent care, leading to prolonged illness.

Steps for the Consumer:

  • Collect all medical records and bills related to the treatment.
  • Attempt resolution with the hospital administration.
  • File a complaint at the District Consumer Forum citing deficiency of service and negligence.
  • Obtain an expert medical opinion supporting the claim.
  • Seek compensation for additional medical expenses, suffering, and loss of wages.
  • Follow legal proceedings and attend hearings until resolution.
