Can a consumer approach consumer courts for poor customer service?

Answer By law4u team

Under the Consumer Protection Act, 2019, consumers have the right to approach consumer courts if they face poor customer service or deficiencies in service. Poor customer service can include delays in responding to complaints, failure to fulfill promises, inadequate after-sales service, or instances where the consumer’s expectations are not met despite the company’s advertised commitments. The law provides consumers with a forum to seek redressal for such grievances, and consumer courts can direct the service provider to resolve the issue, compensate the consumer, or even penalize the company for unfair practices.

Can a Consumer Approach Consumer Courts for Poor Customer Service?

Yes, consumers can approach consumer courts for complaints related to poor customer service. The Consumer Protection Act provides consumers with legal recourse in case of deficiency in service, which includes situations where the service provider fails to meet reasonable expectations or does not fulfill their obligations. Below are the conditions under which consumers can approach consumer forums for poor customer service:

Deficiency in Service

  • If the consumer feels that the service received was substandard or not as promised, they can file a complaint in the consumer courts. This can include issues like:
    • Delayed responses or unhelpful behavior from customer service representatives.
    • Failure to resolve a product/service issue despite repeated follow-ups.
    • Misleading advertisements or false claims about services that were not provided.
    • Poor after-sales support, like faulty repairs or replacement of products.

Unfair Trade Practices

  • If the service provider indulges in unfair trade practices, such as misleading the consumer about the service, overcharging, or providing services that are not in line with the agreement, the consumer can approach the consumer forum for a remedy.

Violation of Consumer Rights

  • When a consumer’s rights are violated, such as in cases of inadequate or negligent service, they are entitled to seek legal action and file a complaint with the appropriate consumer forum.

Steps to Approach Consumer Courts for Poor Customer Service

  • Contact the Service Provider First
Before filing a complaint in consumer court, it’s recommended that the consumer try to resolve the issue directly with the company. Many companies have a grievance redressal mechanism, and issues may be solved through this. Keep a record of all communications (emails, phone calls, letters) with the company, as they will be useful in proving your case.
  • Document the Issue
Gather evidence to support your claim of poor customer service. This can include:
    • Emails or written communication with the company about the issue.
    • Screenshots of complaints or unresolved issues.
    • Receipts or contracts outlining the services agreed upon.
    • Notes on phone calls or conversations that show the deficiency in service.
  • Filing the Complaint in Consumer Court
If the issue is not resolved satisfactorily, the consumer can approach the appropriate consumer forum based on the monetary value involved:
    • District Consumer Disputes Redressal Forum: For claims where the value of the goods or services is less than ₹1 crore.
    • State Consumer Disputes Redressal Commission: For claims exceeding ₹20 lakh but under ₹1 crore.
    • National Consumer Disputes Redressal Commission: For complaints involving amounts above ₹1 crore.
  • To file the complaint:
    • Fill out a complaint form: You can find the necessary forms online or at the respective forum.
    • Submit evidence: Attach supporting documents (proof of purchase, service contracts, correspondence with the company).
    • Pay the filing fee: The fee varies depending on the amount involved.
    • Provide details of the deficiency: Clearly outline how the service was deficient, the actions taken to resolve the issue, and the compensation or solution you are seeking.
  • Consumer Helplines for Guidance
If you’re unsure about how to proceed, you can contact the National Consumer Helpline (NCH) at 1800-11-4000 or 1915. They offer guidance on how to file complaints and provide support through the process.

What Happens After Filing a Complaint?

  • Examination of the Complaint
Once the complaint is filed, the consumer forum will review the case and may ask for further documentation or clarification.
  • Notice to the Opposite Party
If the complaint is accepted, a notice will be sent to the service provider asking for their response. They will have a specific time frame to present their side of the case.
  • Hearing and Resolution
A hearing will be scheduled, during which both parties will present their case. The forum may attempt mediation or pass a judgment based on the evidence.

Possible Outcomes

  • Compensation: The consumer may be awarded compensation for the loss suffered due to poor service.
  • Service Fulfillment: The company may be ordered to fulfill the promised service or correct deficiencies.
  • Refund: In some cases, the consumer may be entitled to a full or partial refund.
  • Penalty on the Service Provider: The forum may impose a fine or penalty on the service provider for failing to adhere to consumer rights or engaging in unfair practices.

Example

Suppose a consumer subscribes to a broadband internet service, and over several months, the internet connection remains unstable, despite multiple complaints. The service provider fails to take corrective action, and the consumer’s repeated requests are ignored.

Steps the consumer should take:

  • Contact the customer service department to resolve the issue and document all communication (emails, call logs, etc.).
  • If the issue is unresolved, file a complaint with the District Consumer Forum providing:
    • The subscription details and the amount paid for the service.
    • Evidence of the complaints and failures of the service provider to address the issue.
  • If the consumer forum rules in the consumer’s favor, they may order the service provider to pay compensation for the loss and failure to deliver the service as promised. The company could also be directed to fulfill the contract by restoring a stable internet connection or refunding the amount paid.
