What compensation can be claimed for defective cosmetics?

  • Refund

  • Replacement of the Defective Product

  • Compensation for Emotional Distress
    In cases where the defective product causes significant distress (such as prolonged skin irritation or permanent cosmetic damage), the consumer may claim compensation for the emotional suffering endured, including psychological effects due to skin conditions or loss of self-esteem.
  • Cost of Legal Proceedings

  • Online Purchases: If bought online, consumers can contact the e-commerce platform's customer service for an immediate solution, including returns or refunds.
  • Offline Purchases: If purchased from a physical store, the consumer should contact the store directly with the product and receipt to request a refund or replacement.
  • Document the Issue
    Keep a record of all communications with the seller or manufacturer, including emails, phone calls, or messages. Also, take photographs or videos of the defective product and any damage caused (such as allergic reactions or burns) to build a strong case.
  • File a Complaint with Consumer Forums
    If the issue remains unresolved or if the seller refuses to offer compensation, the consumer can approach a consumer forum for legal recourse:
    • District Consumer Disputes Redressal Forum: For claims involving amounts less than ₹1 crore.
    • State Consumer Disputes Redressal Commission: For complaints exceeding ₹20 lakh but under ₹1 crore.
    • National Consumer Disputes Redressal Commission: For claims exceeding ₹1 crore.
  • To file the complaint, the consumer must:
    • Fill out the complaint form (available online or at the consumer forum).
    • Provide documents (proof of purchase, photographs of the defect and damage, and communication with the seller).
    • Pay the filing fee (which is generally low and based on the claim amount).
    • Mention the specific compensation being sought, such as a refund, replacement, or compensation for health damages.

    For guidance on how to file a complaint and navigate the legal process, consumers can call the National Consumer Helpline (NCH) at 1800-11-4000 or 1915. The helpline provides assistance on how to proceed with consumer grievances.

What Consumer Forums Do After Receiving the Complaint

  • Examine the Complaint
    The consumer forum will review the complaint and may ask for additional evidence or documents if required. The forum will also issue a notice to the company or manufacturer asking them to respond within a stipulated time.
  • Hearing
    The consumer forum will schedule a hearing where both the consumer and the company will present their case. In some cases, the forum may offer mediation to settle the dispute amicably.
