Can consumers file complaints against fraudulent online charity campaigns?

Answer By law4u team

Fraudulent online charity campaigns have become increasingly common, especially during crises or natural disasters. Scammers exploit consumers’ goodwill by creating fake websites, social media campaigns, or donation portals to collect money or personal data. The law provides multiple avenues for consumers to report such frauds, seek legal redress, and prevent further exploitation. Awareness and vigilance are essential to protect funds and personal information when donating online.

Steps to Report Fraudulent Online Charity Campaigns

Verify the Charity

  • Before donating, check if the charity is registered with the government (e.g., under the Income Tax Act Section 12A or FCRA in India).
  • Look for official websites, verified social media pages, and published annual reports.

Collect Evidence

  • Save screenshots of the campaign, payment receipts, emails, or messages from the charity.
  • Document URLs and names of individuals or organizations involved.

Report to Consumer Forums

  • If financial loss occurs, consumers can file complaints under the Consumer Protection Act 2019.
  • Submit complaints to District, State, or National Consumer Dispute Redressal Commissions depending on the amount involved.

Report to Cybercrime Authorities

  • Lodge complaints with local cybercrime police or via the National Cyber Crime Reporting Portal.
  • Violations of the IT Act 2000 (e.g., sections 66C, 66D, and 43A) can be reported for unauthorized access, data theft, or online fraud.

Report to Central Consumer Protection Authority (CCPA)

  • If misleading advertisements or false claims are made to solicit donations, report to CCPA.
  • The authority can investigate, impose fines, and direct removal of fraudulent campaigns.

Bank and Payment Platform Actions

  • Notify the bank or payment gateway used for donation; they may block transactions or help in fund recovery.
  • File chargeback requests if payment was made through credit/debit cards or UPI platforms.

Consumer Safety Tips for Online Donations

  • Donate only via official charity websites or verified portals.
  • Avoid sharing sensitive information like bank passwords or OTPs.
  • Watch out for urgent appeals or emotional manipulation; scammers often create fake urgency.
  • Check for HTTPS in website URLs and look for trust seals.
  • Regularly monitor bank statements and transaction alerts after donating.
  • Educate family and friends about safe online donation practices.

Example:

A consumer comes across a social media campaign claiming to raise funds for flood victims. They donate ₹5,000, but later discover the organization was fake and the campaign disappeared.

Steps the consumer should take:

  • Collect screenshots of the campaign, transaction receipts, and any correspondence.
  • Report the incident to the National Cyber Crime Reporting Portal.
  • File a complaint with the District Consumer Dispute Redressal Commission if money was lost.
  • Inform the bank/payment gateway and request chargeback or reversal of funds.
  • Report the misleading advertisement to the CCPA.
  • Share information about the fraudulent campaign with friends and social media to prevent others from being scammed.
