Can a consumer file complaints against fraudulent online payment apps?

With the rise of digital payments, fraudulent online payment apps have become a growing threat, often leading to unauthorized transactions, data breaches, and financial loss. The Consumer Protection Act 2019, along with IT Act 2000 and RBI guidelines, offer consumers avenues to file complaints, report fraud, and seek refunds or compensation for financial damages. It’s important for consumers to act swiftly and ensure all necessary steps are followed to protect their rights and secure their financial information.

Steps to File Complaints Against Fraudulent Online Payment Apps

Identify the Fraud and Gather Evidence

  • Check for unauthorized transactions or unexplained deductions on bank statements or app transaction history.
  • Take screenshots or document fraudulent activities, including app details, payment receipts, and messages.
  • Note the app name, developer information, and any communication from the app's support team (if available).

Report the Fraud to the App Developer

  • If possible, contact the app’s customer support team and file a formal complaint about unauthorized charges or fraud.
  • Document all communications with the app’s support for future reference.

Contact Your Bank or Payment Provider

  • Immediately report the fraud to your bank or payment platform if payment was made via UPI, credit/debit cards, or wallets.
  • Request a chargeback or transaction reversal within the time limit provided by your bank or payment provider (usually 3–7 days).
  • Freeze or block the affected account to prevent further unauthorized transactions.

Report the Fraud to Cybercrime Authorities

  • Report the fraud to the National Cyber Crime Reporting Portal (cybercrime.gov.in) or the local cybercrime cell.
  • Submit the evidence, such as app details, transaction records, and communications with the app provider.
  • Provide a clear description of the fraudulent activities, including when and how the fraud occurred.

File a Complaint with the Reserve Bank of India (RBI)

  • If the payment app falls under RBI’s regulated payment systems, you can file a complaint with the RBI via their Banking Ombudsman Scheme.
  • Provide the transaction details, app information, and evidence of fraud to lodge the complaint.

File a Consumer Complaint

  • If the issue remains unresolved, file a complaint with the District, State, or National Consumer Dispute Redressal Commission under the Consumer Protection Act 2019.
  • Cite deficiency of service, unfair trade practices, and the sale of faulty services by the fraudulent payment app.

Seek Compensation

  • Consumers can claim compensation for financial loss due to fraudulent transactions and also demand penalties for the failure of the app to provide proper service or security.
  • You may also seek interest on delayed refunds or compensation for emotional distress caused by the fraud.

  • Always verify payment apps by checking user reviews, ratings, and developer information before installation.
  • Use secure payment methods like UPI, credit/debit cards with 2FA or trusted e-wallets instead of direct bank transfers to mitigate fraud risks.
  • Enable transaction alerts via SMS or email to monitor unauthorized transactions.
  • Never share personal information, bank account details, or passwords over untrusted apps or websites.
  • Regularly update your phone and payment apps to ensure security patches are installed.

A consumer installs a mobile payment app that promises quick loan services. After submitting personal details and linking their bank account, the app makes unauthorized deductions totaling ₹10,000.

  • Report the unauthorized transaction to the app’s customer support and request a refund.
