What compensation is available for online purchased defective electronics?

  • Replacement:
    • If the defect is identified, the consumer can ask for a replacement of the defective item with a new, fully functional unit.
    • Replacement Request: Consumers must raise a complaint with the seller or manufacturer and inform them about the defect. If the seller refuses to replace, the consumer can escalate the matter to the consumer forum.
  • Repair:
    • If the defect is minor and can be repaired, the consumer can request the seller to repair the defective electronic product at no cost within the warranty period.
    • Warranty Terms: The manufacturer’s warranty or seller’s return policy typically covers repairs for manufacturing defects, though consumer rights prevail if the service is inadequate.
  • Compensation for Inconvenience and Loss:
    • If the defect causes significant inconvenience (e.g., if the product is a key device like a smartphone or laptop used for work), the consumer can claim compensation for any loss of time or business disruption.
    • Mental Anguish: If the consumer suffers emotional distress due to the defective product, they may also claim compensation for the mental suffering caused.

Consumer Redressal:

Consumers can approach the Consumer Disputes Redressal Forum if the seller or manufacturer refuses to resolve the issue amicably. Depending on the compensation amount, complaints can be filed in the District, State, or National Consumer Forum.

Steps to Seek Compensation for Defective Electronics:

  • Check the Warranty/Return Policy:
    • Most online sellers and manufacturers offer warranty or return policies for electronics purchased online. The first step is to check the terms and conditions to see if the issue falls within the coverage period.
    • Example: If you bought a smartphone and within a month it shows defects like screen malfunctions or charging issues, it’s typically covered under the warranty.
  • Contact the Seller/Manufacturer:
    • Raise a complaint: Contact the seller’s customer service or the manufacturer’s helpline immediately to report the defect.
    • Request a replacement, repair, or refund based on the terms of the warranty or the return policy.
    • If they don’t resolve the issue, escalate the matter to the higher customer support levels.
  • File a Formal Complaint:
    • If the issue is not resolved within a reasonable period (usually 15 to 30 days), file a formal complaint with the consumer forum. You will need to submit:
      • Proof of purchase (invoice, order receipt)
      • Communication records (emails, chat logs)
      • Details of the defect and any previous complaint or resolution attempts.
  • Filing in Consumer Courts:
    • District Consumer Forum: If the product value is under ₹1 crore, approach the District Consumer Forum.
    • State Consumer Forum: For products with a higher value, or if the issue is unresolved at the district level, escalate to the State Consumer Forum.
    • National Consumer Forum: If the dispute remains unresolved at both lower levels, the National Consumer Forum is the final authority.
    • The consumer can claim refund, replacement, or compensation under the Consumer Protection Act, 2019.
  • Time Limit for Filing Complaints:
    • The complaint must be filed within 2 years from the date of the defect or from the date the consumer became aware of the defect.
