Can consumers approach consumer courts for faulty online insurance claims?

Answer By law4u team

Insurance is a critical financial safety net for consumers, especially when dealing with unforeseen events. However, in some cases, online insurance providers may mishandle claims, refuse payouts, or create obstacles for the insured. This can lead to considerable distress for consumers. Fortunately, consumer laws in India, including the Consumer Protection Act, 2019, provide avenues for consumers to seek redressal through consumer courts if they are dissatisfied with the handling of their online insurance claims.

Can Consumers Approach Consumer Courts for Faulty Online Insurance Claims?

Yes, consumers can approach consumer courts for disputes arising from faulty online insurance claims. If an insurance company has denied a claim without valid reasons, delayed the claim settlement unfairly, or has been misleading about the terms and conditions of the policy, consumers can seek redressal through consumer forums or consumer courts under the Consumer Protection Act.

Procedure for Filing Complaints Against Faulty Online Insurance Claims:

1. First, Contact the Insurance Company

  • Review Your Policy: Go through the terms and conditions of your insurance policy and understand the coverage and exclusions.
  • Document the Issue: Gather all relevant documents such as emails, communication with the insurer, medical reports (for health insurance), or police reports (for motor or property claims).
  • Contact Customer Support: Raise a formal complaint with the customer support team of the insurance company and ask for a clear explanation if your claim is denied or delayed.

2. Raise a Grievance with the Insurance Ombudsman (India)

  • Eligibility: You can approach the Ombudsman if the claim amount is less than ₹30 lakh, and the issue remains unresolved after 30 days of filing a complaint with the insurance company.
  • How to Approach: File your complaint online through the IRDAI portal or directly to the Ombudsman office. The Ombudsman’s decision is binding, although you can still approach consumer forums if you're dissatisfied.

3. Escalate to Consumer Courts

  • If your complaint with the Insurance Ombudsman or the insurance company remains unresolved or the response is unsatisfactory, you can file a complaint in the consumer court.
  • Jurisdiction:
    • District Consumer Forum: Claim amount under ₹1 crore
    • State Consumer Forum: Claim amount between ₹1 crore and ₹10 crore
    • National Consumer Disputes Redressal Commission (NCDRC): Claim amount above ₹10 crore
  • Consumer Rights: The Consumer Protection Act gives you the right to approach consumer courts in case of deficiency of service, fraudulent practices, or unfair trade practices such as denial of claims, unreasonable delays, or false advertisements by online insurance companies.

4. File a Formal Complaint with the Consumer Forum

  • Filing the Complaint: Submit a detailed complaint outlining the issue with the insurance claim, including the policy details, claim amount, supporting documents, and responses from the insurer and Insurance Ombudsman (if applicable).
  • Compensation and Redress: Seek compensation for mental agony, financial loss, and interest on delayed payments. The court may also order the insurance company to pay the claim amount along with damages.

5. Consumer Court Judgment

  • Complaint Settlement: If the consumer court finds in favor of the complainant, the court may direct the insurer to settle the claim within a specific time period and pay compensation for the delay or mishandling of the claim.
  • Appeals Process: If either party is dissatisfied with the decision, they can appeal to a higher consumer forum (State or National Consumer Disputes Redressal Commission).

Example:

Scenario: A consumer purchased an online health insurance policy that covered medical treatment for an accident. After a serious accident, the consumer submitted a claim to the insurance company, but the claim was rejected due to policy exclusions that were not clearly disclosed when purchasing the plan.

Steps Taken:

  • The consumer contacts the insurance company to seek clarification and requests the details of the policy exclusions mentioned in the denial notice.
  • After receiving an unsatisfactory response, the consumer escalates the matter to the Insurance Ombudsman, but the Ombudsman’s resolution still does not lead to a fair settlement.
  • The consumer then approaches the District Consumer Forum with a complaint regarding misleading terms in the policy and wrongful rejection of the claim.
  • The consumer court directs the insurance company to pay the claim and also awards compensation for the emotional distress caused by the delay and rejection of the claim.

Conclusion:

Consumers who face issues with faulty online insurance claims, including claim denial, delays, or misleading terms, have the right to approach consumer courts for redressal under the Consumer Protection Act, 2019. The Insurance Ombudsman provides an initial platform for resolution, but if that fails, consumers can seek legal remedies in consumer forums or consumer courts. These forums offer a quick and affordable means of obtaining compensation for any injustice caused by an insurer's mishandling of claims. By being aware of their rights, consumers can effectively fight for a fair settlement when faced with faulty online insurance claims.
