The District Consumer Forum (DCF) is the first-level consumer dispute redressal forum established under the Consumer Protection Act, 2019. It provides an accessible and efficient platform for consumers to file complaints against goods or services that are defective or deficient. Jurisdiction of District Consumer Forum

Monetary Limit

  • The District Consumer Forum can hear complaints where the value of goods or services, along with compensation claimed, does not exceed ₹1 crore.
  • For disputes exceeding ₹1 crore, the case must be filed in the State Consumer Commission.

Types of Cases Covered

  • Defective Products: Goods that fail to meet quality standards, are damaged, or malfunction prematurely.
  • Deficient Services: Services that are incomplete, substandard, or fail to meet promised standards, such as banking, healthcare, insurance, telecom, or e-commerce services.
  • Unfair Trade Practices: Misleading advertisements, false claims, or fraud by sellers/service providers.
  • Consumer Rights Violations: Denial of warranty, refund, or replacement.

Geographical Jurisdiction

  • The DCF has territorial jurisdiction over complaints filed by consumers residing within the district or where the cause of action arose in the district.

Authority to Grant Relief

  • Can award compensation for loss or injury, replacement of goods, refund of price, or corrective measures in service-related disputes.

Filing Procedure

  • Complaints are filed in the DCF either offline at the district office or online through e-Daakhil.
  • Notice is issued to the opposite party, and hearings are conducted before delivering the verdict.

Appeal Against DCF Orders

  • If a party is dissatisfied with the District Forum’s order, they can appeal to the State Consumer Commission within 30 days of receiving the order.

  • Always verify that your claim value is within ₹1 crore before approaching the DCF.
  • Ensure that the district where you file the complaint is correct, based on your residence or where the transaction/service issue occurred.

Example

Suppose a consumer purchases a washing machine for ₹50,000 from a local store, and it stops working within 3 months despite proper usage. The store refuses to repair or replace it.

Steps to File in District Consumer Forum

  • Since the claim (₹50,000 + compensation) is below ₹1 crore, the consumer approaches the District Consumer Forum in their district.
  • Draft a complaint with purchase bill, warranty card, and repair refusal notice.
  • File the complaint online via e-Daakhil or offline at the DCF office.
  • The forum sends a notice to the store asking for a reply within a stipulated time.
  • Attend hearings and present evidence like bills, photos, and repair requests.
  • The DCF may order the store to replace the washing machine or refund ₹50,000.
  • If the consumer is unhappy with the verdict, they can appeal to the State Consumer Commission.
