The rise of e-commerce in India has brought convenience to millions of consumers. The Act classifies e-commerce businesses into two categories:
    • Marketplace model: Platforms like Amazon, Flipkart, and Myntra that allow third-party sellers to list their products.
    • Inventory-based model: Companies that own and sell their own inventory, such as BigBasket or Zomato.

2. Duties of E-Commerce Platforms and Sellers

  • Providing Clear and Accurate Information: Sellers must provide accurate descriptions of the products or services, including details like price, availability, specifications, and any associated risks.
  • Product Warranties and Guarantees: Sellers must clearly specify any warranties or guarantees offered on products.
  • Return and Refund Policies: E-commerce entities are required to provide a clear return and refund policy and must honor it. Consumers are entitled to a refund or exchange if they receive defective or misrepresented products.
  • No False or Misleading Advertisements: The Act prohibits deceptive advertising practices. If a product or service is misrepresented through advertising, the seller or e-commerce platform can be held accountable.
  • Clear and Transparent Terms of Service: E-commerce platforms are required to display their terms and conditions clearly, including the process for complaints, returns, refunds, and dispute resolution.

3. E-Commerce Consumer Protection Rules (2020)

  • Liability of E-Commerce Platforms: The e-commerce platforms are now directly responsible for ensuring that consumers' rights are protected. They are accountable for any deficiency in service, faulty goods, or products that do not meet the promised standards.
  • Registration and Identity Verification of Sellers: Online platforms must ensure that third-party sellers are registered and verified, reducing the risk of fraudulent or untrustworthy sellers.
  • Refund and Return Procedures: The rules specify the timelines for returning products and obtaining refunds. Consumers must receive a refund within 15 days if they receive defective or incorrect products.
  • Grievance Redressal Mechanism: Platforms are required to have an accessible grievance redressal mechanism for resolving disputes within a certain time frame (usually 30 days).

4. Consumer Protection for E-Commerce Transactions

  • Right to Information: Consumers are entitled to know detailed information about the product or service they are purchasing. This includes clear pricing, terms of sale, and any other relevant details about the product's authenticity, quality, and origin.
  • Right to Refund/Return: Consumers have the right to return goods or services if they are defective, not as described, or fail to meet expectations. E-commerce platforms must provide a transparent return and refund policy and process.
  • Right to Fair Treatment: Consumers must be treated fairly by e-commerce platforms. This includes protection from fraudulent activities, misleading practices, or substandard products and services.

5. Prohibition of Unfair Trade Practices

  • Fake or Counterfeit Products: Platforms that sell counterfeit or fake products are prohibited, and consumers can claim compensation.
  • Misleading Advertisements: E-commerce entities are prohibited from making false claims about the quality or benefits of products or services.
  • Bait and Switch Practices: The Act bans the practice of advertising a product at a low price and then substituting it with a higher-priced item.

6. Protection from Online Fraud and Cybersecurity Risks

  • The Act addresses the growing issue of online fraud by requiring e-commerce platforms to adopt adequate security measures to protect consumers' personal and financial data. It mandates that platforms implement data protection protocols to safeguard consumers from hacking, phishing, or identity theft.

Consumer Redressal Mechanism for E-Commerce Issues

1. Filing Complaints with the E-Commerce Platform

  • If a consumer faces an issue with an online purchase, such as receiving a defective product, delayed delivery, or failure to honor a return policy, they can first approach the seller or e-commerce platform directly for resolution.

2. Consumer Protection Councils

  • If the issue is not resolved by the platform, consumers can approach Consumer Protection Councils or file a formal complaint with the District Consumer Forum. If the value of the dispute exceeds ₹20 lakh, the complaint can be escalated to the State or National Consumer Forum. The Act also provides for the Central Consumer Protection Authority (CCPA), which has the power to investigate and act against unfair trade practices in the e-commerce sector.

3. Timeframe for Redressal

  • Under the Consumer Protection (E-Commerce) Rules, 2020, platforms are required to resolve complaints within 30 days. If the issue is not resolved, the consumer can escalate the complaint to the Consumer Forum.
