What is the procedure for filing complaints in consumer court without lawyer?

Answer By law4u team

The Consumer Protection Act, 2019 allows consumers to file complaints in consumer courts or consumer forums without the need for a lawyer. The process is designed to be consumer-friendly and accessible, ensuring that individuals can seek redressal for grievances related to defective goods, deficient services, or unfair trade practices, even without legal representation. Here's a guide to filing complaints on your own in consumer court.

Steps to File a Complaint in Consumer Court Without a Lawyer

1. Determine the Jurisdiction of the Consumer Forum

The jurisdiction of the consumer forum depends on the value of the claim:

  • District Consumer Forum: For claims up to ₹1 crore.
  • State Consumer Commission: For claims between ₹1 crore and ₹10 crore.
  • National Consumer Commission: For claims above ₹10 crore.

The complaint must be filed in the forum that has jurisdiction over the matter, which is typically determined by the value of the claim or the location where the seller or service provider operates.

2. Prepare the Complaint

Drafting the Complaint: The complaint should be drafted clearly and concisely. It should contain the following:

  • Title of the Complaint: Complaint under the Consumer Protection Act, 2019.
  • Your Personal Details: Name, address, phone number, email, etc.
  • Details of the Opposite Party: Name and address of the seller or service provider against whom the complaint is being filed.
  • Facts of the Case: A detailed description of the product or service, the defect or deficiency, and the timeline of events.
  • Evidence: Attach copies of important documents such as:
    • Purchase receipt or invoice of the product or service.
    • Warranty or service agreement (if applicable).
    • Any correspondence or communication with the opposite party.
    • Photographs or videos showing the defect, if applicable.
  • Relief Sought: Clearly state what relief or remedy you are seeking from the consumer forum, such as repair, replacement, refund, compensation, or other remedies.

3. Submit the Complaint to the Appropriate Forum

Submission: Once the complaint is drafted, you need to file it with the appropriate consumer forum (District, State, or National) based on the value of your claim.

Most consumer forums have a complaint filing window where you can submit your complaint in person. Many forums also allow complaints to be submitted online through official portals.

  • District Forum: If the claim is up to ₹1 crore, file it with the District Consumer Forum of your area.
  • State Commission: If the claim is above ₹1 crore and below ₹10 crore, file it with the State Consumer Commission.
  • National Commission: For claims exceeding ₹10 crore, file the complaint with the National Consumer Commission.

Fee Payment: A nominal fee must be paid while filing the complaint, which can be made through cash, demand draft, or online payment (depending on the court’s facilities). The fee is generally determined based on the value of the claim.

4. Attend the Hearing

Hearing Process: After filing the complaint, the consumer forum will schedule a hearing. At this hearing, you will have the opportunity to present your case, even without a lawyer. You will be required to:

  • Present the facts of the case.
  • Submit all relevant evidence.
  • Answer any questions posed by the forum or the opposite party.

Representation: While you do not need a lawyer, you can represent yourself and argue your case directly. If the forum requires any clarification, you may need to respond or submit additional documents.

Cross-Examination: During the hearing, the opposite party may cross-examine you, but it’s essential to stay calm and provide clear, factual answers.

5. Follow-up and Final Judgment

The forum will pass an order based on the evidence and arguments presented. The judgment could include one or more of the following:

  • Refund of the purchase amount.
  • Replacement of the defective product.
  • Compensation for damages or mental agony.
  • Any other remedy the forum deems fit.

If the opposite party does not comply with the forum's order, you can request execution of the judgment.

6. Appeal Process (If Needed)

If you are unsatisfied with the judgment or the relief provided by the consumer forum, you can file an appeal:

  • District Forum to State Commission: If the order is passed by the District Forum and you’re dissatisfied, you can appeal to the State Commission within 30 days.
  • State Commission to National Commission: If you are unhappy with the State Commission's order, you can appeal to the National Commission within 30 days.

Benefits of Filing Without a Lawyer

  • Cost-Effective: Filing a complaint without a lawyer saves on legal fees. The consumer protection process is designed to be simple enough for self-representation, ensuring that access to justice is available to everyone.
  • Simplified Process: The consumer court system is designed to be consumer-friendly, with easy-to-follow procedures and minimal legal jargon.
  • Quicker Resolution: Cases involving smaller claims can be resolved quickly, without the need for extensive legal procedures or representation.

Example

Case: A consumer purchases a washing machine from a well-known store, and it stops working after three months. Despite several repair attempts, the issue persists. The consumer wants to file a complaint for a refund under warranty.

Steps Taken:

  • The consumer reviews the warranty terms and finds that the appliance is covered for two years.
  • The consumer drafts a complaint to the District Consumer Forum, including:
    • Invoice for the washing machine purchase.
    • Service records showing that the appliance has been repaired multiple times.
    • Correspondence with the seller about the defect.
  • The consumer files the complaint at the District Consumer Forum and pays the filing fee (₹100).
  • The forum schedules a hearing where the consumer presents the case and evidence.
  • After the hearing, the forum orders the seller to replace the washing machine or refund the amount.
  • The seller does not comply, so the consumer files a request for execution of the order with the forum.

Conclusion

Filing a complaint in consumer court without a lawyer is a straightforward and cost-effective process. By following the steps outlined above, consumers can seek redressal for faulty goods, deficient services, or unfair trade practices. Self-representation is encouraged to ensure access to justice, and the Consumer Protection Act, 2019 ensures that consumers can enforce their rights in a simple, efficient manner.
