How can consumers file complaints against counterfeit products?

These products, which may be poorly manufactured, substandard, or harmful, are a growing problem in both physical stores and online marketplaces. The Consumer Protection Act, 2019 offers strong legal protections for consumers against counterfeit goods, allowing them to file complaints and seek remedies like compensation, product replacements, and even penalties for deceptive or fraudulent business practices.

Steps to File Complaints Against Counterfeit Products:

  1. Identify the Counterfeit Product:
    • Signs of Counterfeit Products:
      • Poor Quality: The product may be made of substandard materials.
      • Incorrect Branding: The product may feature misspelled logos, labels, or incorrect brand names.
      • Packaging Issues: Authentic products usually have high-quality packaging. Counterfeits often have improper or cheap packaging.
      • Lack of Certification: Genuine products typically come with warranties, certificates of authenticity, and quality marks.
      • Price Discrepancies: Counterfeit goods are often sold at prices significantly lower than genuine products.
  2. Document the Issue:
    • Retain Evidence: Keep the product packaging, invoice, receipts, and photographs of the product to show discrepancies in the product's quality or authenticity.
    • Compare Products: If possible, compare the product with a genuine version to highlight differences in quality, labeling, and packaging.
    • Record Communications: Save all communication between you and the seller, especially if they fail to acknowledge the counterfeit nature of the product.
  3. Contact the Seller or Manufacturer:
    • Request a Resolution: Inform the seller or manufacturer about the counterfeit product and demand a refund, replacement, or compensation. Provide the supporting evidence.
    • Be Persistent: If the initial response is unsatisfactory, escalate your complaint and demand a resolution under the Consumer Protection Act, 2019.
  4. File a Complaint with the Consumer Forum:
    • Jurisdiction: File your complaint based on the value of your claim:
      • District Consumer Forum: For claims up to ₹1 crore.
      • State Consumer Commission: For claims between ₹1 crore and ₹10 crore.
      • National Consumer Commission: For claims exceeding ₹10 crore.

      • Penalties on the seller or manufacturer for engaging in unfair trade practices.
  5. Report to Regulatory Authorities:
    • Bureau of Indian Standards (BIS): If the product falls under certain regulated categories, you can report counterfeit goods to BIS, which enforces product standards.
    • Department of Consumer Affairs: You can file a complaint with the Consumer Protection Department or relevant state authorities for further investigation.
    • Intellectual Property Rights (IPR) Violations: If the counterfeit product infringes on intellectual property, such as trademarks or patents, you can file a complaint with the Intellectual Property Appellate Board (IPAB) or the Copyright Office.
    • E-Commerce Platforms: If the counterfeit product was purchased through an online platform (e.g., Amazon, Flipkart), report the issue to the platform for action against the seller.
  6. Consumer Helplines and Online Platforms:
    • National Consumer Helpline (NCH): You can report counterfeit products to NCH via its website or helpline number.
    • Consumer Protection Websites: Websites like ConsumerComplaints.in and OnlineConsumerProtection.in allow consumers to post reviews or lodge complaints against counterfeit products.

Legal Remedies Available to Consumers:

  1. Compensation for Loss or Inconvenience:
    • Consumers are entitled to seek compensation for any loss or damage caused by counterfeit products, including financial losses, health impacts, and emotional distress.
    • In cases where counterfeit goods have caused injury or harm, consumers may claim medical expenses or damages for personal injury.
  2. Product Replacement or Refund:
    • Consumers have the right to demand a refund or replacement of the counterfeit product.
    • If the product is defective or harmful, they may also demand a new, genuine product of the same type and value.
  3. Penalties on Sellers/Manufacturers:
    • Under the Consumer Protection Act, 2019, businesses found selling counterfeit goods can face significant penalties, including:
      • Fines for selling counterfeit products.
      • Imprisonment for certain violations of the law related to consumer protection.
      • Mandatory cessation of selling counterfeit goods and corrective measures.
  4. Order for Destruction of Counterfeit Goods:
    • The Consumer Forum may order the destruction of counterfeit goods or direct the seller to withdraw the product from the market.
  5. Public Awareness:
    • The Act empowers consumer forums to ensure public awareness campaigns are carried out to educate consumers about the dangers of counterfeit goods and how to identify them.

A consumer buys a branded smartwatch from an online marketplace. Upon receiving the product, they notice that the watch’s quality is substandard and the branding is not correct. The consumer contacts the seller, but the seller refuses to acknowledge that the product is counterfeit.

Steps the Consumer Should Take:

  • Document the issue: Take photos and compare the product with the original version.
  • Contact the seller: Request a refund or replacement and provide evidence.
  • File a complaint: If the seller does not resolve the issue, file a complaint with the District Consumer Forum.
  • The consumer may claim compensation for the inconvenience caused and demand a refund for the counterfeit item.

  • Buy from Authorized Dealers: To avoid counterfeit products, always purchase from authorized retailers or trusted e-commerce platforms.
  • Check Product Authenticity: Before making a purchase, verify the brand and seller reputation. Many e-commerce platforms have a verified seller badge to ensure authenticity.
  • Report Suspicious Products: If you suspect a product is counterfeit, report it immediately to the seller or e-commerce platform.
  • Check for Certification Marks: Authentic products usually carry certification marks such as ISI, FSSAI, or BIS.
