Can a consumer get compensation for emotional distress caused by online fraud?

Answer By law4u team

Online fraud, such as identity theft, phishing scams, unauthorized charges, and online financial fraud, has become an increasingly common issue for consumers. While the financial implications of fraud are often evident, the emotional and psychological distress that victims experience can be equally significant. This distress may include anxiety, stress, loss of trust, or feelings of vulnerability.

Under the Consumer Protection Act, 2019, consumers have the right to seek redress for losses incurred due to unfair trade practices, including fraud. But what about the emotional toll that fraud victims experience? Is there any provision for seeking compensation for mental anguish or emotional distress caused by online fraud?

Legal Provisions Under the Consumer Protection Act, 2019

The Consumer Protection Act, 2019 primarily focuses on protecting consumers against unfair trade practices and deficient services. While the Act does not specifically mention emotional distress as a category for compensation, it does provide mechanisms for seeking redress for various grievances arising out of online fraud and unfair trade practices. In many cases, consumers who suffer both financial loss and emotional distress may be entitled to compensation.

1. Consumer Rights Under the Act

  • Right to be protected from unfair trade practices: Under Section 2(47) of the Act, misleading advertising, fraudulent activities, and unfair practices like online fraud are prohibited. Consumers who fall victim to such practices can approach the consumer forum to seek redress.
  • Right to seek compensation: Section 14(1) of the Act allows consumers to seek compensation for loss or injury caused due to defective goods or deficient services, which can include emotional distress or mental agony if the fraud causes significant harm.

2. Claims for Emotional Distress

While the Act does not specifically mention emotional distress as a cause for compensation, consumers can claim mental anguish or psychological harm as part of the damages if they can demonstrate that the fraud caused substantial emotional suffering. Courts in India have recognized that emotional distress may be compensable in cases where the harm is severe.

3. Consumer Forum’s Power to Award Compensation

The consumer forum or consumer court has the authority to order compensation for both financial loss and emotional distress under the Consumer Protection Act, 2019. If the consumer can show that the fraud caused substantial mental suffering, the forum can award damages for both the financial loss and the emotional toll caused by the fraud.

How to Claim Compensation for Emotional Distress Caused by Online Fraud

1. Proving Emotional Distress

To claim compensation for emotional distress, the consumer must provide clear evidence that the online fraud caused significant mental anguish or psychological harm. Evidence can include:

  • Medical Records: A report from a psychologist or mental health professional documenting the distress, anxiety, or depression caused by the fraud.
  • Personal Testimony: A personal account of the emotional and psychological toll, such as stress, sleeplessness, or other mental health effects.
  • Witness Testimonies: Statements from family, friends, or colleagues who observed the emotional distress caused by the fraud.
  • Correspondence with Financial Institutions: Emails or communications with banks or online platforms where the consumer reports the emotional toll and stress caused by the fraud.

2. Filing the Complaint

Consumers can file a complaint with the District Consumer Forum, State Consumer Forum, or National Consumer Disputes Redressal Commission (NCDRC), depending on the amount of compensation sought. The steps to file a complaint are:

  • File a Written Complaint: Describe the details of the online fraud and how it has caused both financial loss and emotional distress. Attach all relevant documents such as transaction records, communications with the fraudster, and medical records.
  • Seek Compensation: Explicitly request compensation for both the financial loss (e.g., money lost to fraud) and the emotional distress caused by the experience. Provide any evidence that can support the claim for emotional harm.
  • Court Hearing: The consumer forum will review the case, including the emotional distress evidence, and may summon the offending party (such as an online seller, e-commerce platform, or financial institution) for hearings.

3. Determining the Amount of Compensation

The consumer forum will evaluate the severity of the emotional distress and the financial loss caused by the fraud. The amount of compensation will depend on factors such as:

  • The degree of emotional distress caused.
  • The extent of financial loss due to the fraud.
  • The actions of the fraudster, whether they were deliberate or negligent.
  • Whether the consumer has been diligent in trying to resolve the issue.

Example

Scenario:

Mr. Rajeev falls victim to an online scam where a fraudulent e-commerce website charges him for a product that never arrives. The scam causes him significant emotional distress as he becomes anxious and fearful about future transactions, losing trust in online shopping. He has trouble sleeping and experiences stress for weeks.

Steps Mr. Rajeev Takes:

  • Medical Evidence: He visits a mental health professional who documents his anxiety and stress due to the online fraud.
  • Filing a Complaint: Mr. Rajeev files a complaint with the District Consumer Forum, seeking compensation for both financial loss and the emotional distress caused by the scam.
  • Evidence Submission: He submits the transaction details, medical records, and a personal statement detailing the emotional impact.
  • Consumer Forum Ruling: The consumer forum orders a refund for the money lost in the scam, and also awards compensation for emotional distress based on the evidence provided.

In this case, Mr. Rajeev receives compensation not just for his financial loss, but also for the mental anguish caused by the online fraud.

Conclusion

Under the Consumer Protection Act, 2019, consumers who experience emotional distress due to online fraud can seek compensation for both financial loss and psychological harm. Although the Act primarily addresses issues related to unfair trade practices and deficient services, consumer forums can also award damages for mental anguish when substantial evidence is provided. Consumers should gather all necessary documents, such as medical records and testimony, to prove the emotional impact of the fraud and file a complaint with the appropriate consumer forum to seek redress.
