How to file complaints against fake online gadget sellers?

The rise of online shopping has made it easy to access a wide range of products, including gadgets like smartphones, laptops, and smartwatches. However, the convenience of shopping online also opens the door to fraudulent sellers who offer fake or counterfeit gadgets. These products may look legitimate, but they are often substandard or even dangerous. Fortunately, consumer protection laws, such as the Consumer Protection Act, 2019, provide avenues for consumers to report fake products and seek redress. Here’s how to take action if you’ve encountered a fake gadget seller online.

Steps to File Complaints Against Fake Online Gadget Sellers

Check the Seller’s Return and Refund Policy

  • Step 1: The first step is to contact the seller directly through the platform where the product was purchased. Most e-commerce platforms have clear return and refund policies for counterfeit or defective products.
  • Step 2: If the seller has a return policy, immediately request a return and ask for a refund or replacement of the fake gadget.
  • Step 3: If the product was sold with a warranty, inquire about warranty services or repair options.

Report the Issue to the E-Commerce Platform

If the seller does not respond or refuses to provide a refund or replacement, report the issue directly to the e-commerce platform (e.g., Amazon, Flipkart, eBay). Most platforms have mechanisms to resolve disputes and take action against fraudulent sellers:

  • Step 1: Go to the order details and select the option to report an issue or dispute the order.
  • Step 2: Provide proof of the counterfeit or fake gadget, such as product photos, a description of the problem, and any other relevant details (e.g., invoices, chat logs with the seller).

  • European Union: In the EU, consumers can report the issue to the European Consumer Centres (ECC).

The Consumer Protection Act, 2019 offers strong legal remedies for consumers who are misled by fraudulent sellers or counterfeit products.

  • Section 2(47) - Unfair Trade Practices: Selling counterfeit goods falls under unfair trade practices, which include fraudulent advertising, misleading product descriptions, and selling substandard or fake products.
