What remedies are available for defective online electrical goods?

Purchasing electrical goods online, such as home appliances (microwaves, refrigerators, washing machines), electronics (smartphones, laptops), or other devices, has become increasingly popular due to convenience and better pricing. However, consumers sometimes find that the product they received is defective, either upon delivery or after some use. Under the Consumer Protection Act, 2019, consumers are entitled to certain remedies to address the situation of defective goods, ensuring they are not left with faulty products without recourse.

Remedies Available for Defective Online Electrical Goods

Right to Refund

  • If the electrical product is found to be defective or damaged, consumers can claim a full refund under the Consumer Protection Act, 2019, if the product fails to meet quality standards or is not fit for its intended purpose.
  • Refund is applicable when:
    • The product is found to be defective upon delivery.
    • The product cannot be repaired or replaced.
    • The consumer is not satisfied with the quality or performance of the goods.

Right to Replacement

  • Consumers have the right to demand a replacement if the electrical goods they received are defective. This remedy is available under Section 16 of the Consumer Protection Act, 2019, which provides that the goods should conform to the contract of sale.
  • In the case of faulty appliances, the consumer can request a new replacement of the same product or an equivalent one.
  • The replacement must be done within a reasonable time, usually specified in the warranty or return policy provided by the seller.

Right to Repair

  • If the electrical product is under warranty but has a manufacturing defect or minor fault, the consumer can request the repair of the product free of charge. This is especially applicable if the defect can be fixed without replacing the product entirely.
  • Many products come with a warranty period that entitles the consumer to free repairs or replacement of parts if the goods are defective.

Compensation for Defective Goods

  • If the defective product causes financial loss, damage to property, or personal injury, the consumer is entitled to compensation. For example, if an electrical appliance causes a short circuit or fire, resulting in damage to property, the consumer can seek compensation from the seller or manufacturer.
  • Under Section 2(47) of the Consumer Protection Act, 2019, consumers can claim compensation for mental distress or emotional suffering caused by receiving defective goods.

Consumer Forum Remedies

  • If the seller or manufacturer does not provide the requested remedy (refund, replacement, or repair), the consumer can approach the consumer forum under the Consumer Protection Act, 2019. The consumer can file a complaint with the District Consumer Forum, State Consumer Disputes Redressal Commission, or the National Consumer Disputes Redressal Commission (NCDRC), depending on the value of the claim.
  • The consumer forum will examine the complaint and evidence, including invoices, product specifications, communication records, and inspection reports, and decide on remedies such as refunds, replacements, or compensation.

Steps to Take if You Receive Defective Electrical Goods

Step 1: Verify the Defect

  • Before taking any action, thoroughly check if the product is indeed defective. Ensure it is not a result of misuse or improper handling.
  • For electrical goods, check if the issue is related to wiring, internal components, or factory defects.
  • Test the product according to the manufacturer's instructions to confirm the malfunction.

Step 2: Contact the Seller or Manufacturer

  • If you find a defect, contact the seller or manufacturer immediately. Provide them with detailed information about the product, the defect, and your purchase order.
  • Most online retailers have a return policy or warranty period (usually 7–30 days) during which defective products can be returned or exchanged.

Step 3: Request a Refund, Replacement, or Repair

  • Request the seller for a refund, replacement, or repair based on the terms of their return policy.
  • If the product is under warranty, ask for a repair or replacement under the warranty terms.

Step 4: Follow Up with the Consumer Forum

  • If the seller or manufacturer does not provide an appropriate solution, you can file a complaint with the Consumer Forum.
  • Present all evidence including product invoices, photographs of defects, and communication records with the seller or manufacturer.

Step 5: Report to Consumer Protection Authorities

  • If the defective goods violate consumer rights or if the seller engages in unfair trade practices, file a complaint with the Central Consumer Protection Authority (CCPA) or National Consumer Helpline (NCH).
  • You can also escalate the matter to the RBI or Consumer Protection Agency if the company is found to be operating fraudulently.

Example of Filing a Complaint for Defective Electrical Goods

Scenario:

A consumer buys a microwave oven from an online store. Upon delivery, the microwave does not heat food properly, and a strange smell emanates when it’s turned on. The consumer contacts the seller, requesting a replacement.

Steps the Consumer Should Take:

  • Step 1: Contact the online seller immediately, explaining the issue and requesting a replacement or refund.
  • Step 2: If the seller is unwilling to offer a replacement or refund, file a complaint with the District Consumer Forum.
  • Step 3: Provide evidence, such as the invoice, photographs of the defect, and communication with the seller, in the complaint.
  • Step 4: If the forum rules in favor of the consumer, they may receive a replacement microwave or a full refund for the defective product.

Outcome:

The consumer forum rules that the microwave is defective and orders the online seller to either replace the appliance with a new one or issue a refund to the consumer. The seller is also directed to bear the shipping costs for the defective product.
