What documents are required to file a cheque bounce case?

To file a cheque bounce case under Section 138 of the Negotiable Instruments Act, 1881, the following documents are required: 1. Cheque: A dishonored cheque that was presented for payment and returned due to insufficient funds or any other reason. A copy of the front and back of the dishonored cheque, showing the date of dishonor and the signature of the drawer. 2. Cheque Return Memo: A cheque return memo or bank slip issued by the bank, which states the reason for the dishonor of the cheque (e.g., insufficient funds, account closed, etc.). This document is proof that the cheque was presented and dishonored. 3. Legal Notice: A legal notice sent to the drawer of the cheque demanding payment within 15 days of receiving the cheque return memo. A copy of the notice, along with proof of delivery (e.g., acknowledgment receipt, courier receipt), should be included as evidence. 4. Complaint: The complaint or petition to be filed before the Magistrate under Section 138 of the Negotiable Instruments Act. The complaint should contain: Details of the cheque Date of dishonor Reasons for dishonor (as per the return memo) Details of the notice sent to the drawer Details of the failure to make payment despite notice. 5. Proof of Transaction: Documents evidencing the transaction for which the cheque was issued, such as: Invoice, bill, or agreement to prove that the cheque was issued as part of a debt or liability. Correspondence (email, letters) supporting the nature of the transaction, if available. 6. Identity Proof: Identity proof (e.g., Aadhaar card, passport, voter ID, etc.) of the complainant (the person filing the case). 7. Bank Statement: A bank statement or transaction record showing the date of cheque presentation and dishonor. This is not always mandatory but can be helpful to demonstrate the dishonor clearly. 8. Affidavit: An affidavit affirming the contents of the complaint and the veracity of the facts provided, including the details of the dishonored cheque and the notice sent to the drawer. 9. Power of Attorney (if applicable): If the complainant is a representative or agent of a company, a power of attorney from the company authorizing the individual to file the case may be required. Process: Once these documents are ready, the complainant can file the case in the Magistrate's Court under Section 138 of the Negotiable Instruments Act. The court will then issue a summons to the accused (the drawer of the dishonored cheque), and the case will proceed based on the evidence provided. Having all these documents properly prepared increases the chances of successfully filing and pursuing a cheque bounce case.
