What is a succession certificate?

A succession certificate is a legal document issued by a civil court in India to the legal heirs of a deceased person. It allows the heirs to claim and access debts, securities, or other movable assets (like bank balances, shares, insurance, etc.) that belonged to the deceased. Here are the key points about a succession certificate: It is governed by the Indian Succession Act, 1925 (mainly Sections 370–390). It is applicable when a person dies intestate (i.e., without leaving a valid will). The certificate gives the holder authority to collect debts and securities due to the deceased and to transfer or encash them. It does not give ownership of immovable property like land or houses. For that, legal heirship or other documents may be needed. Who can apply: The legal heir or next of kin of the deceased can apply for the succession certificate in the district court where the deceased last resided or where the assets are located. Process: File a petition with the required documents (death certificate, relationship proof, details of debts/securities). Court issues notice to all concerned parties and may publish it in a newspaper. If no objections are received, and the claim is valid, the court may issue the certificate. Purpose: Banks, companies, and financial institutions generally require a succession certificate to release funds or securities in the name of the deceased to their heirs. A succession certificate is a certificate given to the successor of a deceased person who has not prepared a will.
