The Protection of Women from Domestic Violence Act, 2005 does recognize the fact that emotional or verbal abuse does amount to domestic violence. Domestic violence is defined under Section 3 of the Act as acts, omissions, commissions, or conduct of the respondent (husband of the wife) that injures or harms the mental or physical well-being of the aggrieved person, and includes causing verbal and emotional abuse. Understanding Explanation I to Section 3 clarifies what constitutes "verbal and emotional abuse": Insults, ridicule, humiliation and name calling. Acts of insults or ridicule specifically for not having any child or of a male child. Repeatedly threatening physical pain to any person in whom the husband may have interest. Thus the Act does recognize specific forms of verbal and emotional abuse under the form of domestic violence. One has to see then in this respect whether what one sees qualifies for being labelled as domestic violence.
