Dear Client, The Protection of Women from Domestic Violence Act, 2005 is mostly a civil law. Its primary aim is to extend effective protection and relief to women who become victims of domestic violence. The Act permits an aggrieved woman to go to a Magistrate's Court and seek several civil remedies like protection orders, residence orders, monetary relief, custody of children, and compensation for the injuries sustained. These measures are designed to provide her safety, financial assistance, and dignity in the domestic environment. The trial under this Act is summary and is heard by a Judicial Magistrate of the First Class. But although the Act is civil in conception and intention, it does have some criminal features to make its orders enforceable.For instance, if a respondent disobeys a protection order made by the Magistrate, then such disobedience is a criminal offence under Section 31 of the Act. This can result in imprisonment for up to one year or a fine, or both. The police may also arrest the respondent without warrant in these circumstances. The criminal provisions are meant to act as a deterrent against disobedience of the court orders.
