Dear Client, A succession certificate petition is made to the District Judge under Section 372 of the Indian Succession Act, 1925.It is typically presented by a lawful heir when a person dies without leaving behind a will and his debts or securities like bank balances, fixed deposits, shares, or insurance have to be recovered by the lawful heir. The petition shall have to carry the minimum details like the name, address, and date of death of the deceased, relationship of the petitioner with the deceased, and a statement of all legal heirs. It shall also carry a complete description of the debts and securities for which the certificate is applied. The petitioner should also declare that there is no other pending petition relating to the estate and that they are ready to administer the estate properly. They submit along with the petition documents such as death certificate, address and identity proof, and information about the heirs. After the filing, the court gives notices to the other legal heirs and may also order publication in a newspaper prior to finalizing the matter.
