Yes, a lawyer can be appointed in a domestic violence case under Indian law. Here is a clear explanation: 1. Right to Appoint a Lawyer: The Protection of Women from Domestic Violence Act, 2005 (PWDVA) does not prohibit a woman from appointing a lawyer. The aggrieved woman has the full right to engage a lawyer to represent her before the Magistrate. 2. Legal Aid for Women: If the woman is unable to afford a lawyer, she is entitled to free legal aid under the: Legal Services Authorities Act, 1987 She can apply to the District Legal Services Authority (DLSA) for legal aid. 3. Protection Officer's Role: A Protection Officer (PO) helps the woman file applications and ensures court orders are implemented. But a PO is not a legal representative — so appointing a lawyer is often necessary for proper legal arguments. 4. Respondent (accused) Can Also Appoint a Lawyer: The man (respondent) has equal right to appoint a lawyer for his defense. In summary: Yes, a lawyer can be appointed by either party in a domestic violence case. The woman can also get free legal aid if she cannot afford one. Dear Client, Yes, a lawyer may be appointed in a domestic violence case under the Protection of Women from Domestic Violence Act, 2005 (PWDVA). Section 13 of the PWDVA permits a woman to directly hire a lawyer to appear on her behalf in court. Section 12 also permits her to make an application before the Magistrate on her own or through a Protection Officer or any other person, which may include an advocate. Additionally, under Rule 6(5) of the Protection of Women from Domestic Violence Rules, 2006, if the woman does not have an attorney, then the Protection Officer shall arrange for her legal assistance under the Legal Services Authorities Act, 1987. This implies that she is entitled to free legal assistance from a legal aid attorney if she is unable to afford one. In reality, most women are represented by private counsel or legal aid defence lawyers when it comes to domestic violence.
