Answer By law4u team

Certainly. Here's a detailed answer: Under the Protection of Women from Domestic Violence Act, 2005, no court fee or filing fee is required to lodge a complaint. This is because the Act is intended to be victim-centric and to provide quick and cost-effective remedies to women facing domestic violence. The law ensures that financial constraints do not prevent a woman from seeking protection and justice. A woman who is an "aggrieved person" under this Act — meaning she has been subjected to domestic violence by her husband or any male relative — can file a complaint free of cost through various channels: Protection Officer: The aggrieved woman can approach a Protection Officer appointed under the Act. These officers are responsible for assisting victims, helping them file complaints, and ensuring that they receive necessary support and protection. Police Station: She can also go directly to the police and file a complaint without any charges. Magistrate: An application for relief under the Domestic Violence Act can be submitted before the Metropolitan Magistrate or Judicial Magistrate of the First Class, again without any fee. In addition, the woman can get free legal aid through the District Legal Services Authority (DLSA) under the Legal Services Authorities Act, 1987. Every woman is considered eligible for free legal services regardless of her income, as per Section 12 of that Act. The law also empowers NGOs and service providers to assist victims in filing complaints, and these services are generally offered without cost. In summary: There is no fee required for filing a complaint under the Domestic Violence Act. Victims can approach Protection Officers, police, or magistrates without paying any charge. Free legal aid is available to support the complainant throughout the legal process. The law is designed to ensure easy, quick, and affordable access to justice for women subjected to domestic abuse.

Dear Client, According to the Protection of Women from Domestic Violence Act of 2005 there is no court fee associated with submitting a complaint. Without having to pay an application fee victims can speak with the magistrate directly or through a protection officer. In order to seek protection, maintenance or residence orders under the Act this helps guarantee that women have easy access to legal remedies without having to worry about the cost. I hope this answer helps. In case of future queries, please feel free to contact us. Thank you.
