भारत में प्रमाणपत्र लागू करने की प्रक्रिया प्रमाणपत्र के प्रकार पर निर्भर करती है। मान लीजिए कि आप उत्तराधिकार प्रमाणपत्र (भारतीय उत्तराधिकार अधिनियम, 1925 के तहत) का उल्लेख कर रहे हैं, तो इसे लागू करने की प्रक्रिया इस प्रकार है: 1. उत्तराधिकार प्रमाणपत्र प्राप्त करें: यह जिला न्यायालय (या कुछ मामलों में उच्च न्यायालय) द्वारा मृतक के ऋण, प्रतिभूतियाँ या अन्य चल संपत्तियाँ एकत्र करने के लिए कानूनी उत्तराधिकारियों को अधिकृत करने के लिए जारी किया जाता है। 2. संपत्ति धारकों को प्रमाणपत्र प्रस्तुत करें: प्रमाणपत्र धारक को इसे बैंकों, बीमा कंपनियों, डाकघरों या किसी भी संस्था में प्रस्तुत करना होगा जहाँ मृतक के खाते, शेयर या निवेश थे। 3. प्राधिकारी को इसे स्वीकार करना चाहिए: भारतीय उत्तराधिकार अधिनियम की धारा 381 के तहत, एक बार प्रमाणपत्र प्रस्तुत किए जाने के बाद, संबंधित संस्था को प्रमाणपत्र धारक को संपत्ति जारी करनी होगी। ऐसा करने के लिए उन्हें दायित्व से संरक्षित किया जाता है। 4. संपत्ति का हस्तांतरण या वसूली: प्रमाणपत्र धारक निम्न कार्य कर सकता है: बैंक खातों से पैसे निकाल सकता है प्रतिभूतियों का हस्तांतरण या बिक्री कर सकता है मृतक को दिए गए ऋण वसूल सकता है 5. कानूनी प्रवर्तन (यदि आवश्यक हो): यदि कोई संस्था प्रमाणपत्र का सम्मान करने से इनकार करती है: एक कानूनी नोटिस भेजा जा सकता है। प्रवर्तन के लिए एक दीवानी मुकदमा दायर किया जा सकता है। न्यायालय अनुपालन को बाध्य करने वाले आदेश पारित कर सकता है। 6. संपत्ति का वितरण: यदि कई उत्तराधिकारी शामिल हैं, तो प्रमाणपत्र धारक से पारस्परिक समझौते या लागू व्यक्तिगत उत्तराधिकार कानूनों के अनुसार संपत्ति वितरित करने की अपेक्षा की जाती है। नोट: एक कानूनी उत्तराधिकारी प्रमाणपत्र (राजस्व प्राधिकरण द्वारा जारी) आमतौर पर उत्तराधिकार प्रमाणपत्र की तरह अदालत में लागू नहीं होता है, लेकिन इसका उपयोग प्रशासनिक उद्देश्यों (जैसे, पेंशन दावे, संपत्ति उत्परिवर्तन) के लिए किया जा सकता है।
