In India, traditional knowledge cannot be patented in the usual sense, because patent law is designed to protect novel, inventive, and non-obvious inventions, whereas traditional knowledge is generally already known to the public or part of cultural heritage. Traditional Knowledge Digital Library (TKDL) Documented knowledge of Ayurveda, Unani, Siddha, and Yoga in digital format. Accessible to patent offices to prevent wrongful patents on Indian traditional knowledge. 2. Protection under sui generis laws Instead of patents, India protects traditional knowledge through specific legislations and registries to prevent misappropriation. 3. Defensive Mechanisms TKDL acts as a prior art database, preventing companies from claiming patents on knowledge already in the public domain. 5. Can Any Aspect Be Patented? While traditional knowledge as-is cannot be patented, innovative derivatives or new applications based on traditional knowledge can be patented, if: The invention involves a novel process, formulation, or product. The derivative is not obvious to someone skilled in the art. The invention has industrial applicability and meets patent law criteria. Example: Using a known herbal remedy in a new pharmaceutical formulation that improves efficacy may be patentable. Simply copying an old Ayurvedic recipe cannot be patented. 6. Dear Client, In most cases, traditional knowledge cannot be patented in India or internationally. This is due to traditional knowledge being communal, historical, and already in the public domain, which is why it does not satisfy the novel and inventive step requirements of patent law. Some important points to be noticed here are – 1. The basic requirements under the Patents Act, 1970, must be fulfilled, which are that an invention must be new, non-obvious and useful. Traditional knowledge is not novel because it is already known by communities. 2. Section 3(p) of the Patents Act, 1970, prohibits patents for “an invention which is traditional knowledge or which is an aggregation or duplication of known properties of traditionally known component(s).” 3. Examples of Tradition Knowledge – Ayurveda treatments, medicinal practices by tribes, yoga positions, traditional agricultural practices, and more. 4. Reasons: To prevent biopiracy which is the method where companies patent indigenous knowledge such as neem, turmeric, basmati rice. There are other ways to protect traditional knowledge. This can be done under – 1. Traditional Knowledge Digital Library (TKDL) 2. Biodiversity Act, 2002 3. Geographical Indications (GI) in some cases. I hope this answer helps.
