What is land conversion and when is it required?

Land conversion means changing the legal use of land from one category to another, most commonly from agricultural land to non agricultural use such as residential, commercial, or industrial purposes. This process is officially approved by the government authority so that the land can be used lawfully for the new purpose. In India land conversion is governed by state specific land revenue laws, for example the Gujarat Land Revenue Code, 1879 in Gujarat. The owner must apply to the competent revenue authority and obtain permission before using the land for any purpose other than what is recorded in government records. Land conversion is required when agricultural land is to be used for building a house, starting a business, constructing a factory, plotting land for sale, or any non agricultural activity. Without conversion permission the use of land may be considered illegal and can lead to penalties or demolition actions by authorities.

Dear client, Land conversion is the change in the classification or the permitted use of land as indicated on the official land records by way of a legal process. It may mean conversion of agricultural land into non-agricultural land for a different use such as a residential, commercial or industrial use, or vice versa, when agricultural land is converted into non-agricultural land use for farming. This process is governed by the appropriate State Land Revenue laws and generally requires the permission of the competent authority; i.e. the Deputy Commissioner or District Collector. Land conversion will always be needed when a landowner wants to use the land for a different purpose than what is recorded in revenue records. For example, if agricultural land is to be used for construction, business activities, or layout development, or land classified as non-agricultural is intended to be used for farming, prior approval needs to be obtained from the concerned authority. Without such permission, such a change in the use of the land may be considered unauthorized and may date penalties relating to the laws that govern it. Dear Client, Land conversion exists as a legal procedure which permits landowners to alter their land's official usage rights according to records held by government revenue offices. In India, State land revenue laws establish various revenue record systems which County land use classification systems use to maintain land use records. The Karnataka Land Revenue Act, 1964 establishes agricultural land use restrictions which require Deputy Commissioner approval to convert land for non-agricultural purposes after payment of conversion fees and compliance with specified conditions. Most States have established equivalent regulations through their individual land revenue laws. Land conversion becomes legally necessary when the landholder intends to change the nature of land use recorded in official revenue entries such as the Record of Rights, land register, or patta records. All construction activities on agricultural land require conversion permission from the relevant revenue authority before the start of construction work which includes residential buildings and commercial establishments and factory development and layout construction. The authorities may impose penalties and demolish buildings and revoke approvals for commercial development activities which proceed without the necessary land conversion approvals. The conversion application process requires applicants to provide ownership documents, survey records, land sketches, and payment of required conversion fees. The revenue authorities create new land records after they grant their approval to the request. The documentary records that show ownership and conversion orders and revenue entries serve as valid evidence according to sections 61 and 63 of the Bharatiya Sakshya Adhiniyam 2023. Authorities have the right to start legal actions against land users who exceed their approved land use because of their violation of designated land use standards.
