Yes. A woman can claim maintenance under domestic violence law in India. Under the Protection of Women from Domestic Violence Act, 2005 a woman who is facing domestic violence has the right to seek monetary relief from the respondent. Monetary relief can include maintenance for her living expenses, food, clothing, medical costs, loss of earnings, and expenses for children if any. This relief is meant to ensure that she can maintain a reasonable standard of living similar to what she had during the relationship. The Magistrate has the power to order monthly maintenance or lump sum compensation depending on the facts of the case and the financial capacity of the respondent. The court may also grant interim maintenance during the pendency of the case so that the woman does not suffer financially while the proceedings are ongoing.
