Yes. A woman can seek compensation for mental harassment under Indian law, especially in cases involving domestic violence or cruelty. Under the Protection of Women from Domestic Violence Act, 2005 a woman has the right to claim compensation and damages for mental torture, emotional distress, and physical suffering caused by domestic violence. The Magistrate has the power to award monetary compensation depending on the severity of harassment, the impact on the woman’s life, and the financial capacity of the respondent. This compensation can be granted along with other reliefs such as protection orders, residence orders, and maintenance. Mental harassment may include verbal abuse, threats, humiliation, emotional abuse, controlling behavior, economic abuse, or continuous intimidation. The law recognizes that domestic violence is not limited to physical harm and includes emotional and psychological suffering. Apart from domestic violence law, compensation may also be claimed in certain situations under criminal law provisions such as cruelty by husband or relatives, or through civil remedies depending on the facts of the case. Courts consider evidence such as messages, medical records, witness statements, and circumstances of the case while deciding compensation. If the court grants compensation and the respondent fails to pay, enforcement action can be taken as per law.

Dear Client, Indian law allows women to seek compensation for mental harassment which different legal systems recognize based on the particular type of harassment that they experience. Mental harassment causes permanent damage which violates a person's constitutional rights to dignity and emotional well-being and personal freedom that Article 21 of the Constitution protects. The Protection of Women from Domestic Violence Act 2005 provides women with legal protections because it treats mental abuse as a legitimate basis for women to obtain financial compensation and emotional distress damages which stem from domestic relationships. Mental cruelty functions as a recognized divorce basis which allows individuals to obtain financial compensation according to personal laws as demonstrated by the Supreme Court in V. Bhagat v. D. Bhagat which recognized that continuous mental abuse constitutes a form of legal cruelty. The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 establishes workplace harassment compensation through emotional distress and career loss and trauma, which Vishaka v. State of Rajasthan has validated. When mental harassment occurs, criminal remedies become available through Section 498A of the IPC which includes cases of cruelty and abetment of suicide. Courts have consistently maintained that harassment compensation needs to match the level of harassment and its effects on the victim. Indian law enables women to pursue mental harassment compensation through civil and criminal and statutory legal options which depend on the unique details of each situation. Dear client, Yes, a woman is entitled to compensation for mental harassment under Protection of Women from Domestic Violence Act, 2005. The Act specifically recognizes not only physical abuse, but emotional, verbal and psychological abuse as forms of domestic violence. Under Section 22, the aggrieved woman has the right to claim compensation and damages for mental torture, emotional distress and mental struggles caused by the acts of the respondent. To get such relief, the woman may move the Magistrate seeking such relief either in conjunction with or apart from other reliefs such as protection or maintenance. The court while considering the facts and circumstances of the case might award monetary compensation on the basis of extent of mental harassment, effect on her well-being and cartilage of the respondent. This is provided to ensure that a woman is not only safeguarded from further abuse, but also legally compensated for the harm that she has already suffered.
