Yes, domestic violence cases can affect foreign travel in certain situations, but it is not automatic in every case. Under the Protection of Women from Domestic Violence Act, 2005, courts can pass protection orders, residence orders, and restraining orders against the respondent. If the court believes there is a risk that the respondent may flee the country, avoid proceedings, or violate court directions, it may impose additional restrictions. In some cases, especially where the matter is serious or involves parallel criminal proceedings (like cruelty, harassment, or dowry-related offences), the court can: Direct the person to surrender passport Restrict issuance or renewal of passport Issue a Look Out Circular (LOC) through police authorities to prevent departure from India Require permission from the court before travelling abroad These measures are generally taken when there is a risk of absconding or non-compliance with court proceedings, not in every domestic violence case automatically. If no such restriction is imposed by the court, a person is generally free to travel abroad. However, they must still ensure compliance with any ongoing court orders. In summary, domestic violence proceedings can impact foreign travel only when the court specifically orders restrictions or when related criminal proceedings justify preventive action. Otherwise, travel rights remain unaffected.

Dear Client, If it is you who is being charged for such an incident, it does not mean that traveling to another country will suddenly become challenging since there are various issues regarding the law which need to be taken into account. Traveling abroad may still happen even when the individual is being charged of domestic violence or section 498A crime. Although it is not restricted by any court order or condition imposed during the bail for traveling abroad, it is not quite the case. In other words, the limitation applies when the court orders such condition for the defendant. For example, it may relate to the condition imposed by the court regarding bail, where the defendant should not leave the country without getting a permission. That condition can subsequently be modified, waived, or altered upon application to the court. The more serious risk arises at the destination country. A domestic violence charge can potentially make a person inadmissible in several countries. Moreover, the ability to obtain or renew a passport may be affected. Although each country has its own immigration laws, a domestic violence charge is generally viewed negatively worldwide, affecting the ability to travel freely. However if you are the complainant, you can travel abroad without permission from the court as the cases are filed by you and not against you. However, your advocate must continue appearing on every date, and at the stage of evidence your personal presence will be required. Courts may issue summons to ensure your presence at crucial stages and if you are not present and proceedings are delayed significantly, the court may eventually dismiss the matter. It is advisable to give a power of attorney to a trusted family member for general court appearances and to seek formal exemption from the court for dates when your personal presence is required.
