What documents are needed for inheritance mutation?

For inheritance mutation (mutation of land after death of owner) in India, you need to submit certain documents to the local revenue office so that the legal heirs’ names can be recorded in the land records (Record of Rights). The exact list may vary slightly from state to state, but generally the following documents are required: 1. Death certificate of the original owner This is the most important document. It proves that the recorded owner of the land has passed away. 2. Proof of legal heirs You must show who the legal heirs are. This can include: Legal heir certificate issued by the competent authority, or Succession certificate / family tree certificate (as applicable in the state) 3. Application for mutation A formal written application is submitted to the revenue authority (Tahsildar / Talathi / Patwari), requesting mutation of land in the names of heirs. 4. Affidavit by heirs An affidavit stating: Relationship with the deceased Claim of inheritance Details of other legal heirs (if any) 5. Property documents Latest Record of Rights (ROR) / land record extract Sale deed or old title documents (if available) Survey number / khata number details 6. Identity and address proof Aadhaar card PAN card (if required) Address proof of heirs 7. No objection certificate (if applicable) If there are multiple heirs, sometimes an NOC or consent from other heirs is required for smooth mutation. 8. Court order (if dispute exists) If inheritance is disputed, a civil court order or succession decree may be required instead of mutual consent documents. Important point Mutation through inheritance does not create ownership rights by itself. It only updates revenue records to reflect who is in possession or recognized as heirs. Ownership is governed by succession laws and legal title documents.
