Dear Client, MSME Registration refers to the procedure through which micro, small, and medium enterprises register themselves with the Ministry of Micro, Small and Medium Enterprises. This is a formal procedure of getting registered with the ministry, and there are many benefits that one can enjoy after this process. The act regulating MSME registration in India is the Micro, Small and Medium Enterprises Development Act that has been amended for the last time in 2020 with the help of the MSMED Amendment Act, 2020. Under the current classification, a micro enterprise is one where investment in plant and machinery does not exceed 1 crore rupees and annual turnover does not exceed 5 crore rupees. A Small enterprise has investment not exceeding 10 crore rupees and turnover not exceeding 50 crore rupees. A medium enterprise has investment not exceeding 50 crore and turnover not exceeding 250 crore rupees. These limits apply uniformly to both manufacturing and service sector enterprises, eliminating the earlier distinction between the two. The whole procedure is done via the internet platform for free on the portal www.udyamregistration.gov.in. The applicant has to furnish the aadhar number, PAN, GST numbers where applicable, and some information related to the business. After the successful completion of the procedure, an applicant gets a certificate with a unique registration number of Udyam. There are no requirements to upload any physical documents since everything is integrated with the government’s income tax and GST database system. The benefits of MSME registration are substantial. Registered MSMEs are entitled to priority sector lending from banks at concessional interest rates, collateral free loans under government credit guarantee schemes such as the Credit Guarantee Fund Trust for Micro and Small Enterprises, protection under the MSMED Act's delayed payment provisions which require buyers to pay MSMEs within 45 days and makes delayed payment attract compound interest at three times the RBI bank rate, eligibility for government tenders reserved exclusively for MSMEs, subsidies on patent registration and industrial promotion, and exemption from certain direct tax provisions for eligible enterprises. One of the most practically important protections is the MSME Samadhaan portal. Registered MSMEs can file applications for recovery of delayed payments from buyers before the MSME Facilitation Council, which is empowered to direct arbitration and award interest on delayed payments. Courts including the Supreme Court have upheld the MSMED Act's payment provisions as a special overriding law that takes precedence over general contract law in disputes between MSMEs and their buyersI hope this answer helps, if you have any further query kindly do not hesitate to contact us. Thankyou
