Yes, people from different religions can legally do court marriage in India under the Special Marriage Act, 1954. This law specifically allows interfaith marriages without requiring either person to convert religion. Important conditions: Groom must be at least 21 years old. Bride must be at least 18 years old. Both must give free consent. Neither party should have a living spouse. Parties should not fall within prohibited blood relations unless permitted by custom. Procedure: Notice of intended marriage is submitted before the Marriage Officer. At least one party should generally reside in the district for 30 days before filing notice. Notice is published for objections. If no valid objection is received within 30 days, marriage is solemnized. Marriage takes place before Marriage Officer and 3 witnesses. Dear Client, People from different religions can definitely perform a court marriage in India a specialized framework has been provided by the Parliament for interfaith couples in the form of Special Marriage Act of, 1954. When a couple chooses to perform a court marriage neither of the partner is required to convert to each other’s religion or faith the court sees the marriage as a purely civil contract and completely detached from their religions, customs, traditions, rituals and personal laws. To have a valid marriage under the Special Marriage Act both the individuals must meet the following legal requirements, the groom must be the age of 21 years, the bride must be the age of 18 years, neither of them should have a living spouse from an undivorced marriage and they must not be closely related by blood that is they must not fall within the prohibited relationships unless it is permitted by their custom. Furthermore, by filing a simple 30 day public notice at the local marriage registrar’s office the couple of any religious background can marry under this act and receive a government marriage certificate that will be the legal proof of their marriage. Dear Client, Court marriage under the special marriage act, is specifically designed for exactly this purpose and it is a completely secular form of marriage that applies to any two persons regardless of their religion, caste, community, or background. The Special Marriage Act allows a Hindu and a Muslim, a Christian and a Sikh, or any combination of religions and communities to marry legally before a marriage officer without either party having to convert to the other's religion or perform any religious ceremony. This is the fundamental advantage of the special marriage act over personal law marriages, which require both parties to belong to or convert to the same religion. The conditions that must be satisfied are that both parties must be adults that is 21 years for the male and 18 years for the female and neither should have a living spouse from a previous marriage, and both must give their free and voluntary consent. No parental consent is required since both are adults. The procedure involves giving a notice of intended marriage to the marriage officer of the district where at least one party has resided for at least 30 days. The notice is published and a 30 day objection period follows. Following that, in the absence of any sustained objection to the validity of the marriage, the marriage will be solemnized by the marriage officer in the presence of three witnesses, and the couple will receive their marriage certificate. The marriage certificate is internationally acknowledged for all official purposes. As discussed in an earlier matter in this consultation, High Courts have granted exemption from the 30 day public notice requirement to interfaith couples who demonstrate genuine safety concerns. Couples who fear family opposition should therefore consult an advocate before filing the notice, to assess whether a protective court order should be sought simultaneously.
