Yes, anticipatory bail can be granted even before registration of an FIR in appropriate cases. Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, a person who has reasonable apprehension of arrest for a non-bailable offence may apply for anticipatory bail even if FIR has not yet been lodged. Dear Client, An anticipatory bail application can definitely be filed and granted even before a formal first Information report is registered under the legal framework of Section 482 of the Bharatiya Nagarik Suraksha Sahita, 2023 the crucial question is not the existence of an FIR but it is the presence of the reason to believe that an arrest is imminent or immediate. If a person has a genuine apprehension that he might get arrested due to a malicious prosecution and the offense with regard to which he will get arrested is a non bailable cognizable offense then he has a full right to file an application for anticipatory bail before the Court of Session or the State High Court by demonstrating that he has the fear of such an arrest and it is not based on a mere suspicion. The court will then evaluate the magnitude of the potential allegations and history of the person to decide that whether the protection of anticipatory bail should be granted or not. If such order is granted it serves as a shield in making sure that the person cannot be taken into custody immediately even if an FIR is eventually registered against the person for that specific offense. Yes. Anticipatory bail can be granted even before the registration of an FIR, provided the applicant has a reasonable apprehension of arrest in a non-bailable offence. Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the requirement is that: The person has "reason to believe" that he may be arrested on an accusation of having committed a non-bailable offence. The section does not require that an FIR must already have been registered. The Supreme Court has repeatedly held that the absence of an FIR is not an absolute bar to anticipatory bail if the apprehension of arrest is genuine and based on reasonable grounds. In Gurbaksh Singh Sibbia v. State of Punjab, while interpreting the corresponding provision under the old CrPC (Section 438), the Court emphasized that anticipatory bail should not be restricted by conditions not found in the statute.
