A couple can apply for court marriage before the Marriage Officer under the Special Marriage Act, 1954. Where to apply: Office of the Marriage Officer in the district Usually located in: Sub-Divisional Magistrate (SDM) office District Magistrate (DM) office Designated Registrar of Marriages Jurisdiction rule: Application is generally filed where: At least one of the partners has lived for 30 days before filing the notice. Procedure: Submit Notice of Intended Marriage to the Marriage Officer Notice is displayed publicly for 30 days After 30 days, marriage is solemnized if no valid objection is received Marriage takes place in the office or designated place before Marriage Officer and 3 witnesses Important points: Both parties must be physically present during registration and solemnization Witnesses must also be present with valid identity proof After completion, Marriage Certificate is issued by the Marriage Officer and is legally valid across India Court marriage does not require any religious ceremony and is valid for inter-caste and inter-religion couples.

Dear Client, A couple may apply for a court marriage at the office of the marriage Officer who is often the subdivisional magistrate or district magistrate in the district where at least one of the parties has decided continuously for at least 30 days immediately preceding the date of application. The application process is governed by the following Firstly you must submit the Notice of Intended Marriage to the Marriage Registrar’s office within the jurisdiction where you or your partner has established residency for the mandatory 30- day. Further both the parties must submit proof of age such as a birth certificate 10th grade mark sheet etc, the proof of residential address and affidavits confirming their marital status and that they are not within the prohibited degrees of relationship. Moreover, couple must visit the designated office file the notice in the format prescribed by the Special Marriage Act 1954 and pay the required fees after the application is filed a 30- day public notice. Follows during which a valid legal objection can be raised with regard to the marriage if no objections are raised the couple along with three witnesses possessing valid ID and address proof must appear before the manage officer to solemnize the marriage.
