Which countries have extradition treaties with India?

India has extradition treaties with many countries, allowing the surrender of fugitives between them under the Extradition Act, 1962. Countries with formal extradition treaties with India include: United States United Kingdom Canada Australia United Arab Emirates France Germany Russia South Africa Singapore Sri Lanka Nepal Bhutan Bangladesh Mauritius Thailand Indonesia Saudi Arabia United Arab Emirates (UAE) India also has extradition arrangements or mutual legal assistance agreements (MLATs) with several other countries, even if a full treaty is not present. Important points: Extradition depends on “dual criminality” (offence must be crime in both countries). Even without a treaty, India can request extradition on a diplomatic or case-by-case basis. The process is handled by the Ministry of External Affairs and courts under the Extradition Act.

A treaty is a formal signed agreement between two nations whereas an arrangement is a reciprocal understanding often serving as a framework for cooperation in the absence of a comprehensive treaty. The countries with which India currently has formal extradition treaties are Afghanistan Australia Azerbaijan Behran Bangladesh Belarus Belgium Bhutan Brazil Bulgaria Canada Chile Egypt Germany Hong Kong Indonesia Iran Israel Kuwait Lithuania Malawia Malaysia Mauritius Mexico Mongolia Nepal Netherlands Oman Philippines Poland Portugal Russia Saudi Arabia South Africa South Korea Spain Switzerland Tajakistan Thailand Tunisia Turkey United Arab Emirates United Kingdom Ukraine United States Uzbekistan and Vietnam. Additionally, India has entered into extradition arrangements with around 12 territories. It is important to note that the scope of these arrangements can vary for instance some arrangements such as those with Italy specially confined to crimes related to the illicit traffic of narcotics drugs and psychotropic substances based on their mutual adherence to the 1988 UN Convention furthermore the operational status of these treaties is governed by the Extradition Act of 1962 and requires that the offense in question be punishable in both the requesting and requested states that is the principle of dual criminality by a minimum sentence usually one year of imprisonment.
